What is a mixed pension

A mixed military and civilian pension is a separate type of payment for military personnel, which is calculated based on their work activity in civilian enterprises (or in private organizations) and military service. This type of social support from the state begins to be credited when the serviceman has served the required amount of time - at least 20 years.

Like any income, a mixed social pension can have different sizes. In some cases, financial bonuses for length of service are added to it, and it is also constantly subject to indexation, that is, it increases.

Conditions of appointment

Only those employees of military units whose total work experience is 20 years or more are entitled to a regular military pension. If this condition is not met or cannot be met for a number of reasons, then they are assigned a mixed pension. This is regulated by Part 1. Article 13 of Law No. 4468-1.

Based on the legislation, this type of social benefits is assigned when a person leaves his place of work due to:

  • reorganization of the relevant department;
  • staff reductions;
  • health conditions;
  • reaching the regulated age.

The total combined work experience for a pension should be equal to:

  • for military personnel – 12.5 years;
  • for persons holding positions in the civil sphere - from 25 years.

If at least one of the above conditions is violated, the military man loses the right to receive a mixed social payment. This also applies to officers who retired before they turned 45 years old, or if their total length of service is less than 20 calendar years.

Who has the right

All military personnel who worked in internal affairs bodies have the right to a mixed pension:

  • in the service of the State Fire Service,
  • in the service of the authorities for control over the circulation of narcotic drugs and psychotropic substances,
  • in the service of institutions and bodies of the penal system,
  • in service in the troops of the National Guard of the Russian Federation,
  • in the service of the enforcement authorities of the Russian Federation.

Unlike civil accruals, social mixed payments are not paid upon reaching a certain age. The basis for retiring for military personnel is a total of 20 years of work experience. But it also comes with its own nuances:

  • each year of participation in hostilities is multiplied by three when calculating;
  • being in special conditions for three years is counted as four;
  • early retirement can be made in case of serious injury during the performance of official duties;
  • if a serviceman dies, the widow may claim the payment;
  • employees of the Ministry of Internal Affairs can retire at 45 years of age, the total length of service is not taken into account;
  • When calculating, work experience in other structures is also taken into account.

Also, some military personnel can simultaneously apply for two types of pensions. They can be received directly by the military themselves or their family members. Social payments are issued on general terms.

Length of service

According to the law, bonuses for length of service (length of continuous activity in the military sphere) are accrued under the following conditions:

  • at the time of leaving or dismissal, the total number of years served in the Armed Forces, the Ministry of Emergency Situations, the FSB and other units is at least 20 years;
  • if a serviceman leaves his position over the age of 45, having 25 years of work experience (he must devote at least 12.5 years to work in the military sector).

If a person meets at least one of these requirements, he has the right to claim a cash supplement to his pension in the amount of half the salary he received in his last position. And in the case where the total military work experience exceeds 20 years, he can also receive an additional 1% of his salary for each additional year.

Military personnel, based on the type of their activity associated with an increased danger to life, have a number of benefits and preferences on issues related to pension provision. They have the right to count on payments from the Ministry of Defense upon reaching their seniority. Additionally, like all citizens of the Russian Federation, they can receive a second, civilian one, if after finishing their service they worked in civilian positions. Pension reform and its impact on mixed pensions

In 2020, another pension reform took place in the Russian Federation. Expert opinions about it are contradictory. The retirement age was changed: for men it became 65 years old, for women 60 years old.

This is being done in the interests of equalizing the rights of all pensioners in order to increase the size of social benefits, raising the minimum age limit for retirement.

Also in 2020, a moratorium on indexation of pensions was introduced, which means an actual “freezing” of bonuses to existing social benefits. However, it is already expiring, and this promises positive changes for reserve officers. In the coming years, they can count on at least two stages of increased payments - in October 2020 and 2020.

Calculation example

Let’s assume that a serviceman with the rank of lieutenant colonel is about to retire based on length of service. During his service, he served as deputy regiment commander.

The total experience is about 37 years. In the process of determining length of service, study at a military school was also taken into account.

To determine the amount of the pension payment, we will make the following calculation:

50% + (36 — 20) = 98%

  • 50% - basic salary;
  • 36 years – total experience;
  • 20 years is the required minimum period of experience;
  • 3% – increase for each year after 20 years.

The identified 98% premium cannot be applied, since there is a limit of 85% - this will be used in the calculation.

Let's determine the amount of his allowance:

(7800 + 8500) * 70% = 30,155 rubles

  • 7800 – the size of the salary itself;
  • 8,500 rubles – the amount of salary for performing the duties of a deputy;
  • 70% is the bonus established for him for the hired position (this bonus for each military personnel can be set individually).

Based on the received salary, we calculate pension benefits:

30,155 * 85% = 25,600 rubles

This is exactly the amount a serviceman has the right to count on.

How is it calculated

The amount of the mixed pension is calculated in strict accordance with the methodology approved by law. Instructions for calculations can be found in the same documents. Its norms are specified in Federal Law No. 156. According to this document, when retiring, the pensioner’s work experience and his length of service are taken as a basis. For each additional year above the established level, as stated earlier, a premium of 1% is due.

Minimum pension amount

The average minimum mixed pension for military personnel in the Russian Federation ranges from 15-20 thousand rubles. This figure is approximate, since the pensioner’s membership in special disability groups, length of service and other individual factors are not taken into account: bonuses for ranks, salary for the position held, awards, participation in military conflicts, etc.

Calculation example

The procedure for calculating a mixed military pension has several steps:

  • it is established exactly how many years a person has served, and on the basis of this the amount of the pension payment is determined;
  • mixed work experience in civilian and military positions is determined;
  • the amount of social pension is calculated based on calculations of military payments;
  • the final total is calculated, the amount that the state must transfer to the citizen.

It is also worth noting that completing training at civilian universities and military schools is not considered work experience and is not taken into account during calculations.

Algorithm for identifying years served

The minimum length of service required for social security for a military personnel is 12.5 years.

The required time period includes involvement in various job positions in such law enforcement agencies as:

  • employment in government agencies and law enforcement agencies;
  • if before service a person was in captivity, served a sentence, was detained in cases of unlawful prosecution or illegal repression with subsequent rehabilitation as a result.

Sometimes studying also comes into play.

Important! Service processes included in military service are counted on a calendar basis. But service under special conditions is calculated at a preferential rate. Study is counted as 1 year in 6 months.

Financial maintenance of military personnel for settlements

It is understood as the official salary, summed up from:

  • salary according to military or special rank (without additional payment for exceptional conditions);
  • bonuses due for service before retirement.

If, before retirement, a serviceman was transferred due to poor health from flying positions, service activities on submarines, or nuclear ships to a lower-paid position, then it is permissible to use in the calculations the provision for a career change for these reasons.

Amount of payments for long-term service

The amount of social security for retired servicemen is related to:

  1. number of grace years;
  2. official positions and ranks, being in which the warrior went on a well-deserved rest;
  3. the presence of class ranks;
  4. the presence of financially dependent people.

The more privileges a serviceman has achieved and the longer he has served, the higher his security will be after retirement.

Important! With 20 years of service, you are entitled to 50% material support + 3% allowance for 12 months beyond the 20th anniversary. Those who have a mixed length of service and 25 years of total work experience are credited with 50% of the allowance + 1% for every 12 months over the 25-year period.

The volume of payments should not exceed 85% of the financial content. Incomplete years do not count. The regional coefficients established in the place of residence of the pensioner are applied to the accrued amount. Social security with mixed service is usually less in volume than with 20 years of service.

Attention! Supplements, increases and raises are calculated from the amount of social benefits provided for by Federal Law No. 166 and are considered anew along with the increase in the specified benefit.

Increase in payments to military pensioners

Financial support was previously applied in full, but after its significant increase, restrictions were established for pension calculations. Since 2012, when calculating pensions, monetary allowance began to be taken into account as 54%. From 2013, the increase began again by 2% until reaching 100%. At the same time, the volume of benefits in absolute terms has increased.

Attention! There are categories of security forces for whom the established restrictions do not apply. These are pensioners of the Military Collegium of the Supreme Court of the Russian Federation, military courts, the Prosecutor's Office, and the Investigative Committee of the Russian Federation.

The volume of military pensions is being revised as the earnings of active security forces increase.

In addition to the basic pension amount, some categories of citizens are entitled to increases similar to civil pensions:

  • Heroes of the USSR, Russian Federation, awarded the Order of Glory of 3 degrees - 100%;
  • To the Heroes of Socialist Labor and Labor of the Russian Federation - by 50%.

The following allowances for military personnel, if there are legal grounds, are established:

  • disabled persons 1 gr., persons who have reached the 80th birthday are assigned a 100% premium for inspection;
  • for financially dependent people without ability to work, in the absence of a job for the applicant and a pension for the financially dependent person - 32%, 64% or 100%, depending on the number of dependent persons;
  • WWII participants, if there is no disability - 32%, and upon reaching 80 years old - 64%.

When determining the right to such allowances, military personnel are in a disadvantaged position compared to civilians. The military has limitations in the form of the inevitable lack of work and benefits for the financially dependent; if the 2nd parent is also a pensioner. Civilians have no such restrictions.

Registration procedure

To avoid problems or misunderstandings with the calculation of a mixed pension, the officer must know in advance which package of documents and which authority to contact.

Where to contact

Citizens (with the exception of federal civil servants) can apply for a pension at any time after the right to it arises. An application for a pension can be submitted by a citizen to the territorial body of the Pension Fund of Russia of his choice or to the multifunctional center for the provision of state and municipal services at the citizen’s place of residence (MFC), if between the territorial body of the Pension Fund of the Russian Federation and the multifunctional center for the provision of state and municipal services, an agreement on interaction has been concluded and the submission of the specified application is provided for by the list of state and municipal services provided in the multifunctional center, established by the agreement or by mail.

The application can be submitted personally by the citizen who is assigned the pension, his representative, or through the employer. A citizen can also submit an application in the form of an electronic document through the “Unified Portal of State and Municipal Services (Functions)” or through the “Personal Account of a Citizen” on the official website of the Pension Fund.

Package of documents

To apply for a mixed service pension you will need:

  • statement;
  • identity card and registration documents;
  • a certificate from the place of service that confirms length of service;
  • citizen's military ID;
  • employment history;
  • documents on marital status and presence of dependents;
  • awards, orders and other papers giving the right to apply for bonuses.

In some cases, civil servants may request additional certificates and information from the applicant to accurately determine the amount of social benefits.

How payments are made

Social payments are made in two ways:

  • at the actual address of stay;
  • at the place of registration.

Social pension is paid monthly. The pensioner has the right to choose, at his own discretion, the organization that will deliver the pension, as well as the method of receiving it (at home, at the cash desk of the delivery organization or to his own bank account). In addition, a trusted person can receive a pension for a pensioner. Payment of a pension by power of attorney, the validity of which exceeds one year, is made during the entire validity period of the power of attorney, provided that the pensioner annually confirms the fact of registration at the place of receipt of the pension.

Pension delivery methods:

1. through Russian Post - you can receive your pension at home or yourself at the post office at your place of residence. In this case, each pensioner is given a date for receiving a pension in accordance with the delivery schedule, and the pension can be paid later than the established date within the delivery period. It is better to find out the end date of the payment period in advance, since each post office has its own. If the pension is not received within six months, then its payment is suspended and you will need to write an application to your Pension Fund to resume payment;

2. through a bank - you can receive a pension at the cash desk of a bank branch or apply for a bank card (from July 1, 2017, only cards of the national payment system “MIR” are issued for pension payments) and withdraw funds through an ATM. The pension for the current month is delivered to the account on the day the funds are received from the territorial body of the Pension Fund of Russia. You can withdraw your money from your bank account any day after it is deposited. Crediting to a pensioner's account at a credit institution is carried out without charging a commission.

3. through an organization that delivers pensions - you can receive a pension at home or independently in this organization. A complete list of such organizations in your region (including those that deliver pensions to your home) is at the disposal of the territorial body of the Russian Pension Fund. The procedure for paying a pension through another organization engaged in the delivery of pensions is the same as through a post office.

The size of the military pension is directly related to the amount of monetary allowance, which is the salary of a military personnel depending on rank, conditions of service and the number of allowances. Formation of length of service

Each serviceman, first of all, must independently navigate the issue of forming seniority. As a last resort, upon personal application, you can obtain information from the office or from the pension fund department, but this approach is time-consuming. In addition, in order to calculate the length of service there is no need to thoroughly study Law No. 941 of September 22, 1993, because it is easier to use the main excerpts from it.

Length of service can be summed up from all terms of service, even if it took place in different units. A complete list of structures is presented in the Federal Law and unites various departments.

The above legislative act has developed two annexes that define benefits for military personnel serving in a certain geographic area. The zones listed in the first appendix are considered the most unfavorable, which is the reason for counting one month of service as two months of service. A similar definition is provided for the content of the second application, with the difference that a month is counted as 1.5 months of service.

Training in a military or civilian specialty had and still has a number of nuances related to length of service. The problem is that the legislation has changed since 2001, and for civilians, studying at a university no longer gives additional time to their length of service. Many people tend to transfer this situation to calculate the length of service of a military man. However, there are several situations to consider here.

  • Persons admitted to military educational institutions can sign a contract after the first year. Consequently, they are considered full-fledged military personnel and make contributions to the fund, from which payments will then be made. All years of contract service are included in the preferential length of service on a 1 to 1 basis. This means that one year of study will be counted as one year of service.
  • If a young man studied at a civilian university with a military department, and upon graduation decided to make a military career, then the period of study will be included in the mixed experience in its pure form or in the preferential experience, but will be divided in half. In simple words, 5 years of institute will be counted as 2.5 years of service.
