What is included in the preferential period

The preferential length of service of medical workers does not include the time of removal from duties due to violation of discipline. This means working while intoxicated and failure to comply with safety regulations and other regulations. Legislation

The preferential pension for medical workers is stipulated in Law No. 13 of the Russian Federation “On Labor Pensions of the Russian Federation”. This law states that early retirement is allowed to employees who have worked for the required period of time in medical institutions located both in the city and in rural areas.

Early retirement is allowed for health workers who have worked both in a private clinic and in a public one. Resolution No. 781 of the Russian Federation describes the list of positions that are entitled to a preferential pension and a long-service pension.

List of positions

Medical workers are eligible for this preferential pension only if they performed medical work, and not teaching staff or administrative workers (secretary, accountant).

Who is entitled to a preferential pension - list of positions and institutions

An employee of a medical institution applies for preferential payments in accordance with age if he has accumulated the required number of years of work experience. People retire early, subject to the payment of insurance contributions. Positions that are eligible for benefits:

  1. Junior and mid-level medical workers.
  2. Forensic experts and nurses serving this department.
  3. Laboratory assistants and obstetricians.
  4. Doctors of all specialties.

The law on benefits covers employees of all hospitals and clinics, outpatient clinics, clinics, psychiatric hospitals with inpatients, and medical units. Medical workers

How is a preferential pension calculated for medical workers?

Benefits provided to medical workers are provided regardless of whether they worked in a village or in a city. For this there must be a component of work experience. For rural areas, a length of service of 25 years is considered, for urban institutions - 30 years.

Each year worked according to the work book is considered as a year of experience.

But there are some exceptions to the calculation for retirement:

  1. Honey. an employee who worked in a rural clinic or in a city clinic will have 1.3 years of experience counted as one.
  2. For certain categories, 1.6 years are considered as one. This benefit applies to employees of the following positions: doctors who performed surgical operations, anesthesiologists and resuscitators, pathologists, and forensic experts.
  3. For the categories of specialists indicated in the second paragraph, an experience of 1.9 is counted for one year of work if the employee worked in a village.

Retirement experience for doctors

Decree of the Government of the Russian Federation dated October 29, 2002 No. 781 determined the lists of medical positions that can receive a preferential pension. This is possible if you have the necessary length of service. Its size is regulated by Federal Law No. 400-FZ dated December 28, 2013 (clause 20 part 1):

  • 25 l. - when working in rural areas or urban settlements;
  • 30 l. - with a mixed option (city, village, urban settlement) or only the city.

The position in which the person worked must be provided for by Resolutions No. 781 and No. 665.

400-FZ and the rules for calculating continuous experience, established by the Government of the Russian Federation dated March 28, 2010 No. 189, state in which cases medical experience is interrupted. This is time that exceeds the maximum possible period of absence from work, which is included in the length of service: maternity leave of up to one and a half years (for example, if a doctor did not work for 3 years, only 1.5 of them will be counted), or the period of employment after dismissal when unemployment payments end.

How to apply

The procedure for applying for a preferential pension is the same as for receiving a regular pension, which is assigned for old age. In order to receive a preferential pension in the future, the future pensioner or his representative must go to the pension fund authority at his place of registration, place of stay or his actual place of residence.

To do this you need to provide the following documents:

  • Application for accrual of pension.
  • Passport.
  • Work book.

No state duties are waived and the pension fund cannot require any paid services. A pensioner’s application for pension payments within 10 days is analyzed if they provide all the necessary documents.

A pension is assigned from the day the pensioner applies for its appointment, but not earlier than the period when the medical worker becomes entitled to a preferential pension.

How much experience is needed?

According to all standards and the law of the Russian Federation, medical workers can retire earlier than the required period if a certain length of service is observed. The length of service for employees who work in the village and in the city is slightly different.

For workers in rural medical institutions, the term is 25 years, and for urban workers - 30 years.

If the given work experience established by law is observed, then the health worker can apply for the required rest by contacting the Pension Fund with the necessary documents for registration.

When calculating correctly, it is worth considering that there are periods that can be considered a controversial issue.

Periods that are included in the preferential pension: planned annual vacations, temporary disability (sick leave, for example), maternity leave, internships and courses to improve qualifications and professional abilities, in the case of paid vacations.

The period of work experience may also not include the following periods: maternity leave, combining the main job with a second one, if the main job does not meet the standard hours worked, internship in clinical specializations.

In 2020, changes in the calculation for rural areas are being considered, and the Ministry is planning a resolution on increasing the length of service for retirement. Namely, there are plans to raise it from 25 years to 27.5 years. According to experts, this is not the best that can happen.

If there is an advantage for doctors in the city, they can move to private clinics, where the salary is higher, unlike public ones.

For doctors in rural areas there is no such opportunity, and there is no incentive to work more for the same salary, and this also does not attract young specialists. And soon we will mark this benefit altogether.

The concept of preferential length of service


The right to receive an early pension is a privilege that comes with preferential service. What does this concept mean?

Federal Law No. 173-FZ of December 17, 2001 “On Labor Pensions in the Russian Federation” defines preferential service as the standard of social guarantee that medical workers and other categories of citizens receive. Using this right, doctors become pensioners not upon reaching a certain age, as prescribed by law for citizens on a general basis, but as they complete the established period in a medical institution, in accordance with the norm of Art. 30 of Federal Law No. 400-FZ.

The minimum length of service for health workers in rural areas and urban settlements before retirement is 25 years, for employees in cities, rural areas and urban settlements (or only in cities) - 30 years.

A common situation is when an employee has managed to change several jobs, having worked in the field of medical services both in the village and in the city. Then special rules for calculating length of service are applied, using the established coefficient.

Features of calculating length of service


Federal Law No. 173-FZ of December 17, 2001 “On Labor Pensions in the Russian Federation” defines the rules for calculating preferential length of service that grants the right to early retirement.

According to the rules, 1 year worked in the medical field is added to the length of service as 1 calendar year. But there are a few exceptions.

Under the terms of the Law, workers in rural areas receive pensions 5 years earlier than their urban counterparts .

How is the length of service calculated in the event of a change of place of residence and work? For this, a coefficient of 1.3 is used, which is applied to work experience in rural areas. This means that one calendar year of service is equal to 1 year and 3 months, that is, the length of service accrues faster.

In this case, the employee has to prove the very fact that the enterprise is located in the village, since this circumstance is not indicated in the work book. If the case seems doubtful for the employees of the Pension Fund, then the health worker is asked to provide a certificate from the village council or other self-government body of the locality where he worked.

The procedure for calculating length of service for some specialties that differ in working conditions is not without nuances.

Thus, using a coefficient of 1.6, the length of service is calculated for the approved list of positions in the following departments:

  • Surgery.
  • Resuscitation.
  • Prosektura.
  • Forensic examination.

The coefficients when calculating length of service are summed up if a medical worker claims benefits for several positions.
Thus, an employee of a pathology department in a rural area applies for a calculation of length of service in which 1 year is taken as 1 year and 9 months. A special procedure is provided for those who worked part-time in their position, or accumulated experience while working two part-time jobs.

The law requires such health workers to confirm that they have fully completed the standard in the position that entitles them to the benefit. These rules do not in any way affect the calculation of the length of service of nurses.

When calculating length of service, the peculiarities of the work schedule associated with public holidays or other events are not taken into account - if the working week was shortened, this will not affect output in any way.

Periods counted towards length of service


In addition to the main periods of employment, the following periods are counted towards the preferential length of service:

  • The periods during which the employee received temporary disability benefits (sick leave, labor and employment leave).
  • Annual paid holidays.
  • Passing a probationary period when hiring.

The experience does not include:

  • Unpaid vacations.
  • Child care leave up to 1.5 and up to 3 years.
  • Residency period.
  • Periods during which violations of discipline by the employee were detected (working while intoxicated, failure to comply with safety regulations, etc.)

The subject of ongoing debate is the issue of including in the length of service periods during which the employee improved his professional qualifications.

Since advanced training and completion of such courses is the responsibility of a medical worker, dictated by law, it is considered fair to include these periods in the length of service for receiving an early pension.

The territorial body of the Pension Fund does not count these periods into the preferential period. To include them, you will need to go to court.

Required documents

Receiving a preferential pension is handled by a body such as the Pension Fund; to register, you need to contact this body with a certain package of documents:

  • The employee’s work book (this book is based on the calculation of the official work experience), and photocopies of all its pages.
  • A confirmation sheet from each place of work stating that the work activity was related specifically to treatment, and not training or management.
  • Applicant's passport.
  • Certificate from your last place of work.
  • A written application from a PF employee regarding retirement.
  • Salary certificate for the last 5 years.
  • Certificate of family history and place of residence.

With these documents in hand, you can apply for retirement based on years of service.

What will change after the reform?

The pension reform for medical workers also brought several innovations, among which we can highlight the introduction of a deferment for the right to retire on a preferential length of service.

According to Law 350-FZ, adopted on October 3, 2020, the preferential pension for medical workers in 2020 includes the fact that every year a deferment will be introduced for the application of preferential length of service. The deferment period will increase gradually until the period reaches 5 years in 2025.

From 2020, the deferment period will increase by 1 year each year. But for 2020 and 2020, an increase is not provided for 1 year, but a gradual increase of 6 months.

In this case, a deferment is understood as a set period of time, which increases the required time to receive a pension for preferential service.

Appointment procedure

A medical employee who has developed the necessary length of service to apply for a pension is supposed to contact the Pension Fund with the collected necessary documents, which are written above. The documents provided must be originals, as well as provide duplicates of all documents.

Copies of documents remain with the Pension Fund and are attached to the citizen’s file.

Pension workers check all the documents provided; if any documents are missing, they offer to collect the remaining ones and bring them. If all the required documents are available, a pension card is created for the citizen, to which copies of all papers are attached.

A submitted application for a preferential pension must be considered within 10 days. The pension is calculated from the first day of application to the Pension Fund, but not before agreement on the pensioner’s status.

Submission of documents is provided two months before the due date, which already provides for pension payments.
