What it is?

Currently, the pension consists of two components, namely insurance and basic.

The size of the insurance portion depends on the length of service, membership in a certain preferential category or other circumstances. And the basic part of the pension is unchanged and is paid regardless of the onset of disability, death of the breadwinner or reaching a certain age.

That is, the fixed part of the pension is the minimum that is guaranteed to every citizen when establishing a pension, regardless of the grounds for its assignment.

What is the basic part and the insurance part of the pension?

Pension accruals include three components:

The last of the components is not relevant to today's pensioners, since it was introduced relatively recently. This point will be relied upon when calculating pensions today for working citizens. The basic component is common to everyone. It has a fixed amount and is subject to indexation annually.

The insurance part is precisely based on the length of service and level of income of a person during his working life. Each employee made monthly contributions from his monthly earnings to the insurance fund. It is these contributions that are the basis for the formation of the insurance share of the pension accrual. It is calculated quite simply: the level of contributions to the insurance fund is divided by 19 - the expected number of years that the pensioner will live. The labor pension consists of the sum of these two components.

Fixed basic amount of old-age labor pension in 2018

The basic part of pension accruals is, to some extent, a certain guarantee of provision for Russians of retirement age. Article 16 of Federal Law No. 400 establishes that this is a fixed component of payments with a certain amount.

Today, the basic portion for a citizen who leaves his position due to reaching retirement age is 4,805.11 rubles. In 2002, this amount was 450 rubles/month, and increased annually through indexation.

This share of accruals is mandatory for all pensioners with more than 5 years of work experience. The main goal of this part is to establish some kind of social guarantee for citizens.

What funds are used to finance the payment of the basic part of the pension?

The formation of the fundamental component occurs through contributions from enterprises. Until 2005, they paid 28% of the unified social tax, of which half went to the main part of pensions, and the second half to insurance. After 2005, this percentage was lowered to 20, and the part of contributions to the indigenous component decreased to 6%.

Despite this, payments are made from the state budget and do not depend on the specific amount of contributions made by the employee during the employment relationship. Thus, the government has committed itself to ensuring a minimum amount of payments and promises their gradual increase.

Normative base

The procedure for assigning a fixed payment is regulated by the norms of Article 16 of Federal Law No. 400, which states that the amount of the basic payment depends, first of all, on the category of persons who apply for pension coverage, as well as on factors accompanying their work activity or marital status.

The size of the FBR (fixed base size) is influenced by the presence of northern work experience, the disability group, and the IPC of the deceased breadwinner, not to mention employment after receiving a pension or the presence of dependents.

Sizing and application in various fields of activity

The basic value in the Republic of Belarus is an economic indicator that determines the value of money, not related to the assessment of intangible or material benefits, and is used as a guideline for calculations.

On January 1, 2002, a base value index was introduced in Belarus; previously, the amount of fines or bonuses was calculated based on the minimum wage, but this indicator began to grow sharply, and the use of this method became unacceptable for citizens.

Now the number of basic quantities controls a number of financial issues (present in 300 legal acts). The base value is used to calculate:

  • fines for breaking the law;
  • payment of benefits or bonuses;
  • setting standards for allowances or surcharges.

The size of the base value depends on labor standards and is established by the Council of Ministers of the Republic of Belarus.

From what means is it formed?

In accordance with Part 3 of Article 6 of Federal Law No. 167, the fixed base is formed from funds transferred by workers as mandatory contributions to the Pension Fund of the Russian Federation.

Moreover, in relation to minors who apply to receive part of the FBI, the presence of insurance, as well as the transfer of funds, is not necessary, given that contributions were paid by deceased breadwinners.

Size

In accordance with Article 16 of Federal Law No. 400, the amount of the basic payment depends on the type of pension, as well as other factors:

  • degree of health limitation;
  • presence of dependents and their number;
  • the age of the pensioner, namely after 80 years or before;
  • work experience in the Northern regions.

Is it the same for everyone or not?

Based on Article 16 of Federal Law No. 400, the size of the basic pension is not set at the same amount for all pensioners, but quite the opposite.

All applicants can count on the minimum portion, except for survivors’ pension recipients, given that they are entitled to the FBI only in the amount of half the basic portion, that is, 2,402.5 rubles. And only northerners can count on the maximum, people who have reached the age of eighty or have received group 1 disability - 21,622.98 rubles.

The average FBR amount for all other categories of pensioners varies from 6.5 thousand to 19 thousand rubles.

How much is it today?

The basic part of the fixed payment as of 02/01/2017 is equal to 4805.11 rubles, but this is the minimum payment.

If a pensioner has a group 1 disability, the agreed part of his benefit will be 9610.22 rubles, and if he has dependents and is 80 years of age - 11211.92 rubles. Persons who have northern experience can apply for the FBI from 7,207 rubles to 21,622 rubles, directly depending on the length of service, region of work and age, not to mention the maintenance of dependents.

In law enforcement agencies

Despite the fact that the service pension is mentioned in Federal Law No. 400, the pension provision of military personnel is regulated by another federal act, namely the Law of the Russian Federation No. 4468-1, according to which this category is not entitled to the FBI, since the amount of their pensions (Article .14) is calculated as a percentage of the previously received monetary allowance in proportion to the existing period of service.

At the same time, in accordance with Article 46 of Law No. 4468-1, the minimum amount of pension provision for military personnel is the basic part of the social pension on the basis of Article 18 of Federal Law No. 166 in the amount of 3,771.78 rubles, taking into account indexation by 1.04, to which an allowance for dependents or special merits during the period of service in accordance with the standards specified in Article 45 of Law No. 4468-1.

By disability

According to the norms specified in Article 16 of Federal Law No. 400, disabled people have the right to a basic pension, but in an amount that depends on the group.

In accordance with Part 2 of Article 16 of Federal Law No. 400, in case of disability group 3, the FBI will amount to only 50% of the state basic pension - 2402.5 rubles, in case of the second group - 4805.11. But what the pension of a disabled person of group 1 is equal to will depend on several factors.

For example, the minimum pension in accordance with Article 17 of Federal Law No. 400 for this category will be 9610.22 rubles, and in the presence of persons who are supported - from 11211.92 to 14415.32 rubles. taking into account the number of persons in custody.

Moreover, if a disabled person of group 1 has northern experience, his pension will be 14,415.32 rubles, and when caring for other pensioners who are unable to support themselves - 21,622.98 rubles.

In the Far North

Based on Part 4 of Article 17 of Federal Law No. 400, an increased level of FBI and workers from the northern regions is provided.

If you have at least 15 years of northern experience and a total work period of 25 and 20 years (for male and female workers), the basic basis increases by 50% - 7207.67 rubles. In the event that a northern worker is 80 years old or has been assigned 1 gram of disability, the FBI will be paid monthly in the amount of -14,415.33 rubles, and if there are dependents, another 50% for each.

If a northerner has worked in conditions equivalent to northern ones for more than 20 years, again with general experience, the FBI will be increased by 30% - 6246.64 rubles, and if dependents are supported - another 30% for each, which, in general will range from 8328.85 to 12493.27 rubles. Accordingly, after 80 years of age or if there is a disability, the size of the base will also be increased to the level of 12,493.27 rubles.

If you have a dependent

The concept of the term “dependent” is contained in Article 179 of the Labor Code of the Russian Federation, which states that a dependent is a person recognized as disabled in the manner prescribed by law, who is fully or partially supported by another person.

At the same time, children are automatically recognized as dependents due to their age, but relatives must confirm their status, so to speak, through disability and a small pension, which will give the breadwinner the right to increase the fixed amount.

in accordance with Article 17 of Federal Law No. 400, for persons who worked in areas equivalent to the northern ones, the FBI will be increased for each dependent by 30%, and for northerners - by 50%, while for pensioners who do not have benefits, the basic part will also be increased for providing assistance to relatives will be increased by 50% for each person they help, but not more than 150% in total.

Officials

Based on Article 19 of Federal Law No. 400, civil servants have the right to a pension in a special manner, which provides for the possibility of receiving 2 benefits simultaneously - a long-service pension in accordance with Article 7 of Federal Law No. 166 and part of the insurance benefit in accordance with Article 19 of Federal Law No. 400.

At the same time, for this category of persons, a fixed part of the pension is not established, with the exception of cases of registration of one type of pension, namely an old-age pension, in the general manner.

For working pensioners

In accordance with Article 16 of Federal Law No. 400, upon reaching retirement age and applying for a specified type of benefit, the FBI is paid to all categories of pensioners, regardless of whether they continue to work or have switched to legal rest.

But at the same time, in accordance with Article 7 of Federal Law No. 385, FBI indexation is not carried out for working pensioners.

That is, until the worker retires completely, the size of the fixed base will be the minimum established initially, without taking into account inflation and increasing the FBR by the corresponding coefficient over subsequent years, not only in relation to the base, but also the old-age benefit.

For Afghans

Afghans, in accordance with Article 3 of Federal Law No. 5, are combat veterans with a certain set of social benefits. services and compensation payments, which are intended in gratitude for the fulfillment of an international duty.

But at the same time, the agreed payments do not relate to pension provision, which Afghans have the right to count on in accordance with the procedure established by Federal Law No. 400 on a general basis, and in the event of disability - in connection with a wound or injury received during hostilities in accordance with the norms of Law No. 4468 -1.

For individual entrepreneurs

Based on Article 4 of Federal Law No. 400, the right to pension provision arises only if certain mandatory conditions are met, one of which is the transfer of contributions to the Pension Fund of the Russian Federation.

If an entrepreneur, during his activities in accordance with Article 7 of Federal Law No. 167, makes contributions to the Pension Fund of the Russian Federation, the period of contributions is taken into account in the total length of service and, therefore, upon reaching retirement age, the individual entrepreneur has the right to count on a pension in the general manner with payment from the FBI.

Size in 2020

Federal Law No. 400, which regulates the procedure for pension provision and establishes the amount of accruals, including the FBR, was adopted at the end of 2013, but over several years, due to economic problems and a decline in production, prices for the main groups of products increased, which is why it was a decision was made to index pension benefits depending on the level of inflation.

Minimum

One more fact should be noted: in accordance with the law, social security cannot be less than the established minimum for living, in general in the Russian Federation or in the constituent entities of the Russian Federation. For example, in Moscow the minimum is 10,670 rubles, and in St. Petersburg 9,617.90 rubles.

Consequently, the pension of an elderly person in general, taking into account the fixed payment as well, cannot be lower than the agreed level.

Early assignment of old-age labor pension

An old-age labor pension can be assigned before reaching the generally established retirement age (men 60 years old, women 55 years old).

In accordance with pension legislation, such rights are granted to those established by the relevant law:

  • professional categories of citizens;
  • social categories of citizens.

The retirement age for these categories of citizens depends on:

  • depending on the type of work
  • required general insurance experience
  • required experience in relevant types of work.

Labor pensions for long service, disability and survivors may have increased values.

At the same time, the size of the increase in labor pension depends on the specific category of recipients of increased pensions.

Insurance part of old-age labor pension for military personnel

Many military personnel, becoming pensioners at the age of 40-50, continue after leaving military service to work as employees in positions not related to military service.

In this case, the employer makes monetary contributions for him to the insurance (and savings) part of the individual personal account.

As a result, a pension capital is formed on the individual personal account of a military pensioner, which, in accordance with the Law of July 22, 2008 No. 156-FZ “On Amendments to Certain Legislative Acts of the Russian Federation on Pension Issues”), if the necessary conditions occur, is paid to him as the insurance part of the old-age labor pension, with the exception of its fixed basic amount.

The insurance part of the old-age labor pension for military pensioners is assigned subject to the following conditions:

  • reaching the generally established retirement age: 55 years and 60 years (for women and men, respectively);
  • the presence of an insurance period of at least 5 years, not taken into account when assigning a pension through the law enforcement agency;
  • the presence of an established pension for long service or disability, provided for by the Federal Law of February 12, 1993 No. 4468-I “On pension provision for persons who served in military service in the internal affairs bodies, the State Fire Service, agencies for control of the circulation of narcotic drugs and psychotropic substances substances, institutions and bodies of the penal system, and their families";

For certain categories of military pensioners, the insurance part of the old-age labor pension is assigned before reaching the specified age, subject to the conditions for early assignment of the old-age labor pension.

As a general rule, the insurance part of an old-age labor pension is assigned from the date of application for it, but not earlier than from the date the right to the specified part of the labor pension arises.

At the same time, the Law of July 22, 2008 No. 156-FZ “On Amendments to Certain Legislative Acts of the Russian Federation on Pension Issues” provides for the extension of the rules on establishing the insurance part of the old-age labor pension for military pensioners to legal relations that arose from January 1, 2007 of the year.

This means that military personnel who met the listed conditions for the appointment of the insurance part of the old-age labor pension in the period from January 1, 2007 to July 24, 2008 inclusive (i.e., before the date of entry into force of the specified Federal Law), the specified part of the labor pension old age can be assigned from January 1, 2007, regardless of the time of application for it, but not earlier than from the date the right to it arises.

For military personnel whose right to the insurance part of an old-age labor pension arose after the entry into force of this Federal Law (i.e., from July 25, 2008 and later), this part of the labor pension is assigned according to the general rules.

To assign the specified part of the labor pension, you must contact the territorial body of the Pension Fund of the Russian Federation with an application for the appointment of the insurance part of the old-age labor pension and present the following documents:

  • passport;
  • insurance certificate of compulsory pension insurance (in case of its absence, the specified document is issued by the territorial body of the Pension Fund of the Russian Federation at the request of the insured person);
  • certificate of receipt of a long service pension (disability pension) in accordance with the Law of the Russian Federation dated February 12, 1993 No. 4468-1 “On pension provision for persons who served in military service, service in internal affairs bodies, the State Fire Service, and control bodies trafficking in narcotic drugs and psychotropic substances, institutions and bodies of the penal system, and their families,” and periods of service, work and other activities taken into account when determining the amount of a long-service pension (about periods of service preceding the award of a disability pension). The certificate is issued by the authorized body of the federal executive body that provides pensions to persons who have served in military and equivalent service, and members of their families, in the prescribed form;
  • documents confirming work experience (for example, a work record book, an employment contract, certificates issued by employers or relevant state (municipal) bodies, etc.).

In addition, a military pensioner with periods of work before 2002 can submit documents confirming the average monthly earnings for any 60 consecutive months before 01/01/2002, if this average monthly earnings falls on the period before the registration of the insured person in the compulsory pension system insurance.

According to the current pension legislation, the amount of the old-age labor pension consists of the insurance and funded parts of the old-age labor pension.

The size of the funded part of the old-age labor pension is determined by the formula:

Basic pension in 2020

According to the norms enshrined in Article 16 of Federal Law No. 400, the basic basis is calculated for the citizen who applied for registration of a pension automatically, but taking into account the length of service and the presence of dependents, not to mention the disability group or period of work of breadwinners.

Submission rules

Federal Law No. 400 provides for three types of pensions:

  • by old age;
  • on disability;
  • upon the loss of the main breadwinner.

To assign specified types, a certain list of mandatory conditions must be met:

  • confirm your experience;
  • presence of disability;
  • reaching a certain age;
  • loss of livelihood due to the absence of a breadwinner.

Experience

The length of service when applying for a pension benefit for any of the above-mentioned types of pensions is of decisive importance, affecting the amount of the benefit.

In accordance with Article 8 of Federal Law No. 400, when applying for an old-age pension, you must confirm the presence of fifteen years of employment history. In accordance with Article 9 of Federal Law No. 400, a disability pension will be established regardless of the group of labor loss, but only if there is a minimum length of service. And benefits for the loss of the main breadwinner in accordance with Article 10 of Federal Law No. 400 will be provided, again based on the periods of employment of the breadwinner before death.

If future pensioners do not have work experience, they will be assigned a pension in accordance with Federal Law No. 166. That is, they will be allocated a social pension benefit, which does not imply additional payment in the form of the FBI.

Age

To apply for a benefit that includes the FBI, the future pensioner must confirm not only his length of service, but also reach a certain age, which is important for an old-age pension.

In accordance with Article 8 of Federal Law No. 400, the pension will be calculated only from the age of 60 for males and from the age of 55 for females. Although, on the basis of Article 30 of Federal Law No. 400, a pension can be issued early, but only under the condition of harmful length of service or other circumstances that imply work in conditions deviating from the norm and excessive workload.

For persons who apply for a pension due to limited ability to work or the loss of their main breadwinner, there is no age limit, given that citizens can lose their ability to work or lose a loved one at any time.

Documentation

In accordance with Part 6 of Article 21 of the Federal Law, the establishment of a pension of any type, as well as a fixed part, is made only after submitting a package of documents approved by Order of the Ministry of Labor No. 958n.

You must submit to the Pension Fund at your place of residence:

  • passport;
  • document confirming periods of work;
  • disability certificate and supporting medical certificate. documentation;
  • marriage and birth certificates;
  • certificate of earnings at the place of work;
  • certificate of family composition;
  • certificate of place of residence;
  • a certificate confirming the absence of pension accrual for other reasons.

In particular, to confirm the maintenance of dependents or the loss of a breadwinner, documents of the specified persons are required about their identity and financial condition, not to mention the place of residence, which is necessary to receive a pension in any case.

Accruals

The determination of the future pension amount is made only after checking the submitted documents for authenticity and confirmation of work experience in accordance with Article 14 of Federal Law No. 400.

In this case, accrual is made from the date of registration of the application with the package of documents listed above, despite the fact that the verification can last up to three months.

Calculation

Initially, a fixed part in the minimum amount is accepted for calculation, that is, 4805.11 rubles, then, depending on the confirming data from the FBI, it can be increased.

Eg:

If there is 1 dependent, say the same disabled child, the base portion will increase by 30%.

4805.11 + (4805.11 x 33.33%) = 6406.81 rubles.

If we are talking about northern experience, then the basic part will increase by 50%:

4805.11 + (4805.11 x 50%) = 7207.67 rubles.

Recalculation

As a rule, the pension, including the basic one, is established at the time of registration, taking into account the data recorded in documents.

But after several years, life circumstances may change, and therefore there will be grounds for recalculating the basic benefit.

In accordance with Article 18 of Federal Law No. 400, the size of the FBR can be changed at the request of the pensioner himself if he has the right to receive this type of pension on two grounds simultaneously.

Also, the amount of the FBR can be recalculated if the pensioner has taken care of a close relative recognized as disabled.

And of course, the FBI will be changed, but automatically for a pension from the age of eighty, which now amounts to 9,610.22 rubles.
