How many points in Pf when caring for a disabled child

Sooner or later, many of us find ourselves in a seemingly hopeless situation when we have to choose: work or care for elderly parents or sick relatives. An equally complex problem has to be solved by older people themselves, disabled people who cannot cope without outside help.

In these and similar cases, someone turns to social workers who provide help and support to those in need in accordance with current legislation, or to Orthodox nurses.

But there is another option provided for by pension legislation. It allows caring for a disabled person with a certain monetary payment.

Caring is also a job

Today, many thousands of citizens have taken advantage of this right. They, being people of working age, do not work anywhere, but only take care of the elderly and disabled and receive money for it.

  • Compensation payment is paid

    :

* for care:

- for disabled people of group I,

- for older people who, based on the conclusion of a medical institution, need constant outside care,

— for elderly people 80 years of age and older;

* to a carer - a relative or a stranger living with the person he is caring for, or in another place, if he:

- of working age,

- does not work anywhere (does not receive a salary) and is not registered with the employment service (does not receive unemployment benefits);

* in the amount of 1200 rubles (monthly, together with the pension of the pensioner being cared for).

2. Monthly cash payment is paid

:

* for care:

- for a disabled child,

- for a disabled person from childhood, group I;

* to a carer - a relative or a stranger living with the person he is caring for, or in another place, if he:

- of working age,

- does not work anywhere (does not receive a salary) and is not registered with the employment service (does not receive unemployment benefits);

* at the rate of:

— 10,000 rub. – parent (adoptive parent), guardian (trustee),

— 1200 rub. – to other persons.

Important!

  • A compensation payment is also due in the case where an elderly or disabled person is cared for by a high school student (from 14 years of age) or a student, even if he receives a scholarship;
  • If a carer gets a job or starts receiving unemployment benefits, he is obliged to inform the Pension Fund about this so that there are no overpayments that will still have to be returned - voluntarily or in court.

Pension points for childcare periods

As experts from the regional branch of the Pension Fund of the Russian Federation note, such recalculation is not beneficial for all pensioners.
This depends on individual indicators - the formed pension rights, according to which the citizen’s pension is calculated. This can be beneficial for mothers of many children who were unable to develop a long service record, for citizens who have low wages or do not have a salary certificate at the time of granting a pension, and also if the period of care fell during the period of study. As a rule, recalculation is not beneficial for those whose pension was calculated taking into account maximum length of service and earnings, or who have one or two children. If periods of child care coincide in time with periods of work, one of the periods is taken into account in the insurance period - the one with regard to which the pension amount will be higher. Pension Fund specialists choose the most beneficial option for the citizen for calculating the pension.

Benefit for caring for a disabled person of group 1 in 2020

A group 1 disabled person is a person whose physical or mental abilities differ from normal by 80-90%. Such people need help and constant care, since they are not able to care for themselves. That is why the state prescribes the need to provide disabled people with guardians, who, in turn, are entitled to financial support. How to receive benefits for caring for a disabled person of group 1? Let's talk about the necessary documents and conditions for processing payments.

Legal representatives of young children who have become disabled, as well as people with disabilities of group 1 since childhood (regardless of age), should be aware of the additional features of compensation payments for the care of these categories of persons. Thus, the amount of social payments depends on the status of citizens caring for a person in need of help in relation to him.

What documents are needed to receive payments?

To apply for benefits for caring for an incapacitated person, you will need to provide the following package of papers:

  • passport with registration, SNILS;
  • certificates proving that the guardian or other person agrees to care for a disabled individual who is not listed on the labor exchange as unemployed and does not receive an insurance pension benefit;
  • a document that proves a citizen’s disability and specifies what specific disability group the person has. This certificate is issued after a medical examination, which is carried out at the Bureau of Medical and Social Expertise;
  • if a disabled child needs care - a certificate of recognition of the disability of a minor citizen;
  • for elderly people in need of outside assistance, a medical certificate will be required that will prove the need for regular care;
  • the work book of the trustee, where there is a record of his dismissal, as well as the official work book of the individual in need of help (if such a document exists);
  • If a child who is 14 years of age or older is ready to look after an incapacitated citizen, the consent of his father/mother or guardian will be required. But caring for a disabled person should not take up study time. Helping an elderly or disabled person in need of care is possible only during free time from school;
  • a person who has expressed a desire to care for an elderly or disabled person will need to prove to the Pension Fund of the Russian Federation that he does not receive payments as a former military man, as a former employee of internal departments, etc.

When the papers are collected, you must contact the Pension Fund of the Russian Federation at the place of registration of the incapacitated person to apply for benefits. You will also need to provide:

  • a statement from the caregiver that he will care for a specific person who needs assistance;
  • written consent of a disabled person to receive assistance from a specific person.

An application for consent to receive help from a caregiver can only be prepared by a legally capable disabled person who is at least 14 years old. If we are talking about a disabled child who is under 14 years old, or if we are talking about a person who is incapacitated, then the application must be prepared by his parents/guardians.

On a note!

Since the end of 2020, it has become possible to submit the application mentioned above through a personal profile on the website of the Pension Fund of the Russian Federation or through the government services portal.

How many pension points are awarded when caring for two disabled persons at the same time?

Women who retired before January 1, 2020 and gave birth to children have the right to recalculate their pension taking into account child care periods. Specialists of the PFR Branch for the Trans-Baikal Territory spoke about who benefits from such recalculation and what documents are needed for this

The period of caring for elderly citizens over 80 years of age, or disabled people of group 1 (disabled children) is counted in the insurance period along with periods of work. But this does not change the main principle: each time period (a year or more) is counted towards the length of service only once.

Who is eligible?

An early (preferential) pension for the parents of a child disabled from childhood can be issued only if the child is raised until the age of 8 . Thus, this benefit can be assigned when the father reaches 55 years of age, and the mother reaches 50 years of age, and if their insurance experience is not less than 20 and 15 years for a man and a woman, respectively. The law also provides that early retirement to care for a disabled child is possible not only for the parents or relatives of a minor, but also for his guardian under the conditions and in the manner prescribed by the legislation of the Russian Federation.

Let us clarify that we are talking about people of working age who not only care for an elderly person or a sick child, but do it officially by declaring this to the Pension Fund. They receive compensation and monthly care payments for this. In addition, the periods that a person devoted to caring for a loved one are counted towards his length of service. This means that pension points are added to him - 1.8 points for each full year of such departure.

Key nuances when assigning compensation payments

When planning to arrange care, a person has many questions, for example, what documents need to be provided, how much the person who will provide care is paid, how payment is made, and others. Next, we will try to answer them in as much detail as possible.

Payment of benefits is terminated when the incapacitated citizen is in a special institution of federal (municipal) subordination

Requirements for a caring citizen

The legislation establishes certain requirements for persons caring for disabled people of the first group and other categories of citizens in need, which we will discuss further.

A person applying for social assistance must meet the following requirements :

  • able-bodied citizen (over 14 years old);
  • absence of employment marks in the work book at the time of registration of the benefit;
  • lack of other sources of income (insurance pension, unemployment benefits, etc.).

Note ! The requirement for sources of income is immutable. The reason for this requirement is to reimburse the trustee for his or her earnings. When a guardian already receives federal social support, he does not have the right to apply for benefits for caring for a disabled person.

The law prescribes that the caregiver is obliged to inform the Pension Fund of the Russian Federation when going to work (employment) or assigning him an old-age pension. You must report this no later than 5 days and write an application for refusal to receive compensation.

If the application was not written, but compensation was paid from the moment other income arose, then he will need to return the overpayment. Otherwise, his actions are considered illegal .

When caring for a disabled child or someone who has been disabled since childhood, the guardian parent is assigned a payment of 5,500 rubles

Important ! During the period of care, an able-bodied woman will retain the right to receive BIR benefits at her place of employment, but with the condition that care begins no later than the 30th day from the date of dismissal. In addition, young people of military age who care for a disabled citizen, in the absence of other relatives of the disabled person, receive a deferment from military service.

Amounts of compensation for caring for a disabled person and an elderly citizen

Compensation is paid for each incapacitated disabled person for whom care is provided. The legislation does not prohibit providing care to several disabled people (elderly people) who need it at the same time . Above we mentioned persons who, in accordance with the law, require care.

Since last year, the amount of benefits for caring for one disabled person (elderly citizen) has been increased and currently it is 1.5 thousand rubles.

Amounts of compensation payments for caring for a disabled child and a disabled child

The official representative of a disabled minor child and a disabled person from childhood (regardless of age category) needs to know about the important nuances of receiving compensation payments assigned when caring for these categories of people. The amount of compensation will depend on the status of the citizen providing care.

The amount of compensation will depend on the status of the citizen providing care

Compensation is assigned in the following order:

  1. Parents (adoptive parents/trustees/guardians) are assigned an additional increase to the social payment of a disabled person in the amount of 5.5 thousand rubles. If any coefficient is established for the region of residence, then compensation is indexed accordingly.
  2. Other persons who provide care for this category of disabled citizens are awarded a social benefit in the amount of 1.5 thousand rubles.

These rules for calculating social compensation are regulated by Decree of the President of the Russian Federation No. 175 . It is necessary to explain in more detail how this regulation is applied in practice. Let's take the following situation as an example. The mother takes care of a disabled child, after some time she decided to return to work (get a job), and the grandmother is with the child during her absence. Does the mother of a disabled child need to apply for a waiver of compensation payments at the place of their destination?

The question cannot be raised in this way , since, according to the law, she must refuse benefits no later than 5 days from the moment she started working, and therefore receiving official income. And the grandmother needs to apply for social benefits, but in this case the amount of payments will be reduced, which will be 1.5 thousand rubles. In addition, the grandmother’s insurance pension will be suspended.

Important ! The time interval when an able-bodied person provides care for a disabled person will be counted in the caregiver’s work experience. The only condition for its accrual is the presence of official employment before the start of care or after its completion.

    How many points in Pf when caring for a disabled child

    “Starting from 2020, when calculating pensions, a special role will be played by length of service and receipt of official wages ,” said Marina Mokrousova, head of the press service of the OPFR in Mordovia. “The pension rights of citizens to an insurance pension will be reflected in individual pension coefficients (points) determined for every year of operation.

    The insurance period includes periods of labor activity for which insurance contributions to the Pension Fund were accrued and paid. According to the new rules, the so-called “ non-insurance periods ” will also be included in the length of service. For example, military service, caring for a disabled child, a disabled person of group 1, a citizen over 80 years old, or someone in need of outside care (according to the conclusion of a medical institution). For these periods, special annual coefficients are assigned if the citizen did not work during this time. For example, for a year of military service a person receives 1.8 points. The same amount for caring for group I disabled people, disabled children, and people over 80 years old.

    Range of requirements for a guardian

    • 1 Range of requirements for a guardian
    • 2 What is the amount of compensation accrual today?
    • 3 What documents are needed to receive payments?
    • 4 Questions and answers

    In 2008, the President signed a Decree on financial assistance payments.
    It is allocated for persons caring for a disabled child. This document states that a person caring for an incompetent person with a Group 1 disability is entitled to monthly payments. But compensation for caring for a disabled person is provided only to those persons who do not receive a pension or salary. Few people know that this decree also affects people who care for people who have reached 80 years of age, as well as those who look after people with disabilities of group 1. In this case, the fact of blood relationship and the place where the trustee lives are not taken into account. The following can count on help from the government apparatus:

    • able-bodied caregiver;
    • unemployed, able-bodied citizen;
    • a person who does not have additional sources of income (the person should not have a pension, salary or any other benefits). Such conditions are set so that the state apparatus, while helping the trustee, is confident that it is reimbursing the citizen’s labor earnings. If a person receives certain money transfers from the state treasury, then he should not count on another payment.

    The law says that a trustee who decides to go back to work or starts receiving a pension must inform the Pension Fund about this moment. This must be done within 5 days after the person has decided to stop caring for the patient and his life circumstances have changed somewhat. When notifying the Pension Fund about changed circumstances, the guardian will have to formalize a refusal to receive social benefits for caring for a disabled person of group 1.

    If a person violated the deadlines and did not submit an application for refusal of benefits to representatives of the Pension Fund of the Russian Federation, he will eventually be forced to return the received budget money. Otherwise, his actions will be considered illegal.

    The procedure for obtaining early pensions for parents of disabled children

    In turn, the PF, after receiving the documents, must carry out a number of actions. In particular, to begin with, the length of service of a woman or a man will be taken into account in accordance with Article 14 of Federal Law No. 400, which provides for verification of the transfer of contributions to the fund and confirmation of length of service, which will be converted into pension points. Then, based on the agreed data, a payment file will be generated and the pension benefit will be calculated in accordance with the length of service.

    Early retirement of parents of disabled children

    Benefits and retirement for mothers of disabled children are formed on the basis of current regulations. Federal laws regulate the release of actual care for women at 50 years old, and for fathers at 55. Before submitting an application, you should familiarize yourself with the registration process and the amount of support.

    Who is recognized as disabled group I

    An able-bodied person will be recognized as a disabled person of group I under certain conditions that are clearly stated in legislative acts. After receiving the status of a disabled person, he has the right to receive appropriate social support :

    • medical care – providing a disabled person with the necessary medicines and treatment;
    • special means for visually impaired people - appropriate literature, access to the library;
    • hearing aids, if a disabled person requires them;
    • social assistance in the form of subsidies and assistance to improve living conditions.

    The legislation clearly defines the parameters that play a role in obtaining disability of the first group (see Table 1).

    To confirm these disorders and deviations that limit the vitality of a citizen, you should start with a visit to the doctor monitoring the patient . The final decision is made by an expert medical commission based on relevant documents and an assessment of the patient’s general condition.
