    Pension reform, which began in 2002, was aimed at creating professional pension systems. The absence of a basic law in this area has led to the emergence of separate regulatory documents, the purpose of which is to increase the degree of material support for certain categories of citizens due to their implementation of certain professional activities .

    The additional payment serves as an additional guarantee in the field of social security due to the harmful, stressful and dangerous circumstances of work of a special nature.

    To increase the pension of flight crew members of civil aviation vessels (CA) and coal industry workers (CP) and with the required length of service in these positions, they are provided with special additional payments to their pension by the Russian Pension Fund (PFR).

    Who is entitled to a pension supplement?

    This type of pension provision can be paid only to certain professional categories of citizens, namely those who are members of civil aviation flight crews or UP employees (in underground and open-pit mining).

    Funds for the payment of additional payments come to the Pension Fund from organizations (contribution payers) that use the labor of these citizens to achieve their goals.

    Members of flight crews of civil aviation aircraft

    According to the law of November 27, 2001 No. 155-FZ “On additional social security for flight crew members of civil aviation aircraft,” the following flight crew members have the opportunity to receive additional payment:

    • Citizens of the Russian Federation receiving a pension.
    • Having length of service in the position: for men - at least 25 years;
    • for women - at least 20 years.
  • Moreover, upon leaving flight work for health reasons length of service must be:
      for men - at least 20 years;
  • for women - at least 15 years.
  • The list of professions of flight crew members, service in which provides an opportunity for additional payment to the pension, as well as the rules for calculating length of service to establish it, were approved by Government Decree of March 14, 2003 N 155 “ On approval of the list of positions of flight crew members of civil aviation aircraft, work which gives the right to a monthly supplement to the pension"

    Coal industry workers

    According to the law of May 10, 2010 No. 84-FZ “On additional social security for certain categories of employees of coal industry organizations”:

    • Citizens of the Russian Federation receiving a pension.
    • Coal industry workers who worked all day long in underground and open-pit mining operations (personnel of mine rescue units inclusive) in the extraction of coal and shale and in the construction of mines - 25 years.
    • Employees of leading professions - longwall miners, mining operators, tunnelers, jackhammer operators - 20 years.

    If the applicant does not have sufficient experience, he can work in the appropriate position and then send his application to the Pension Fund.

    Preliminary information about pension supplements

    in accordance with Federal Law No. 155-FZ

    Since the second quarter of 2020, a very difficult financial and economic situation has developed in civil aviation. International flights have been suspended since March 26 and this ban has been extended until August 1.

    The volume of work has decreased sharply, and civil aviation is suffering huge financial losses.

    Air transportation, as a field of activity, is included in the list of sectors of the Russian economy most affected by the spread of the new coronavirus infection; 19 airlines, performing 95% of air transportation, are included in the list of systemically important enterprises in Russia and the Government of the Russian Federation provides them with support.

    Unfortunately, some unscrupulous employers, taking advantage of the coronavirus situation, once again through the Association of Air Transport Operators turned to the First Deputy Chairman of the Government of the Russian Federation A.R. Belousov with a proposal to reduce the contribution rate or suspend contributions from April to December 2020, or even repeal Federal Law No. 155-FZ, and thus solve the problems of civil aviation at the expense of veteran pilots. Airlines' expenses for implementing Law No. 155-FZ range from 0.5% to 0.7% and, naturally, do not solve the financial problems of the aviation industry.

    The Russian Flight Crew Trade Union sent two letters to the Government of the Russian Federation dated March 25, 2020 and April 20, 2020, which drew attention to the specifics of the implementation of Federal Law No. 155-FZ and proposed support measures in the form of issuing interest-free loans to airlines to pay dues .

    Federal Law No. 155-FZ and the 14% tariff were upheld.

    Due to a significant drop in air travel, the receipt of insurance premiums in April, May and June, compared to the first quarter, decreased by 3.2 times.

    According to preliminary calculations, the maximum additional payment to the pension will be 8200-8500 rubles. The average additional payment is 6,000 rubles.

    In this difficult time, the President of the PLC of Russia M.Yu. Boychuk regularly negotiates with the Pension Fund of Russia (PFR), the Ministry of Labor, the Ministry of Finance, the Ministry of Transport and the Federal Air Transport Agency on the issue of providing support in the implementation of Federal Law No. 155-FZ.

    According to the PFR information (letter sent to the RTK dated June 22, 2020 No. NP-02-11/12212), in the draft main characteristics of the PFR budget for 2021 and for the planning period of 2022 and 2023, when forecasting income to the PFR budget, contributions from organizations using labor of flight crew members of civil aviation aircraft, credited to the Pension Fund for the payment of additional payments to pensions for 2021 in the amount of 9.6 billion rubles, for 2022 - 10.8 billion rubles, for 2023 - 11.0 billion . rub. The draft budgets have been drawn up taking into account the increase in contributions received compared to 2020.

    The request was initiated by the Russian PLC at the working group of the Russian Tripartite Commission for the Regulation of Social and Labor Relations under the Government of the Russian Federation.

    I hope that air travel will recover, salaries and contributions will increase, and the amount of the pension supplement will return to the amounts paid in 2019.

    On July 6, 2020, President of the country Vladimir Putin met with the head of Aeroflot PJSC Vitaly Savelyev. The main topic of the conversation was the resumption of international flights. The timing of the opening of the borders of European states for Russians is still difficult to predict, the President of the Russian Federation said.

    At the meeting, the head of state asked V. Savelyev to assess the current state of the industry, as well as to share his opinion on ways out of the situation. The head of Aeroflot PJSC predicts reaching the 2020 level of traffic by December 2020 for domestic flights and for international traffic by March 2021.

    Amounts of pension supplements for certain categories of citizens

    A pension supplement is an independent payment and its amount does not depend on the type and amount of the previously assigned pension for which it was approved.

    Its size depends on:

    • length of service;
    • the average monthly salary of the person applying for the specified payment;
    • the amount of contributions credited to the Pension Fund budget from institutions employing the labor of these groups of persons.

    The long-service bonus with the required length of service will be 55% of the salary. It must be borne in mind that for every 365 days in excess of the length of service you receive 1%, but the total payment should not exceed 75%.

    The amount of the surcharge is calculated according to the formula:

    RD = SZP x (ZR / ZP) x K x (SV / SVD),

    Where:

    • RD - the amount of additional payment to the established pension;
    • SWP – average monthly earnings;
      In the interval from July 1 to September 30, 2001, to calculate and increase the size of state pensions, adopted by the Government of the Russian Federation, increased by all annual growth rates of average monthly earnings determined by the Government of the Russian Federation in accordance with the law of December 17, 2001 No. 173-FZ “On Labor pensions in the Russian Federation", and from January 1, 2020 - to the annual growth indices of the average monthly salary adopted by the Government of the Russian Federation for the purpose of implementing this law;
    • ZR - the average monthly earnings of a citizen in a position that makes it possible to assign an additional payment, accrued at the choice of the worker for the last 2 years of work or for any 5 consecutive years of such work;
    • ZP – average monthly salary in the Russian Federation for the same time interval;
    • K is a coefficient that takes into account the share of the average monthly salary, which is due depending on professional experience, from which the additional payment is calculated. *
    • SV – average amount of contributions, penalties and fines accrued to the Pension Fund budget in the previous quarter from contribution payers over the months of operation;
    • SVD - the amount of funds to finance expenses for the payment of the established additional payment at the beginning of the payment period.

    * — For civil aviation flight crew members : with 25 years of experience for men and 20 years for women, the coefficient is 0.55. For a full year worked, more than the specified length of service, it increases by 0.01, but cannot be more than 0.75. When leaving a given job due to health reasons, the coefficient, which takes into account the share of the average monthly salary of a flight crew member with less than 25 years of experience for men and 20 years for women, decreases by 0.02 for each year;

    For UP employees : with 25 years of experience in underground and open-pit mining (personnel of mine rescue units inclusive) in coal and shale mining and mine construction, or at least 20 years of service in the professions - longwall miners, drifters, jackhammer operators, drivers of mining excavation machines, the coefficient is 0.55. For a full year worked more than the specified period in these jobs, it increases by 0.01.

    In the Volgograd region, 490 pilots and 72 coal industry workers are recipients of pension supplements.

    The amount of the additional payment is individual and depends on the length of special service (length of service) and the citizen’s earnings. In addition, the ratio of the amount of contributions, penalties and fines to the Pension Fund of the Russian Federation received in the previous quarter from organizations using the labor of these categories of persons to the amount of funds necessary to finance these additional payments is taken into account.

    In this regard, the amount of additional payments changes every three months: from February 1, from May 1, from August 1 and from November 1.

    The average amount of additional payment in the Volgograd region has changed since November 1, 2019 and is: for pilots - 16,589.08 rubles, for miners - 3,582.16 rubles.

    Deadlines for establishing professional pension supplements

    The assignment and payment (renewal) of additional pension benefits, recalculation of its value is carried out in the manner prescribed by Art. 2 of Law No. 155-FZ and Art. 1 No. 84-FZ of the Law “On additional social security for certain categories of employees of coal industry organizations”

    . The assignment and renewal of payments, as well as recalculation, occur within the given time frame:

    • from May 1 , if the application was made from January 1 to March 31 ;
    • from August 1 , if the application was made from April 1 to June 30 ;
    • from November 1 , if the application was made from July 1 to September 30 ;
    • from February 1 , if the application was made from October 1 to December 31 of the previous year.

    These deadlines are related to the reporting periods established for organizations to pay contributions to finance additional payments to pensions.

    What to follow

    The main regulatory document on this issue is Law No. 155-FZ of November 27, 2001 “On additional social security for members of flight crews of civil aviation aircraft.”

    According to the law, an additional payment to the pension is assigned if there is length of service as a flight crew member:

    • at least 25 years – for men;
    • at least 20 years for women.

    When leaving flight work in a position that gives the right to receive an additional payment to the pension, due to health reasons:

    • at least 20 years – for men;
    • at least 15 years – for women.

    How to apply for a pension supplement

    The territorial body of the Pension Fund of the Russian Federation assigns additional payments to the pension of civil aviation flight personnel. To do this, you need to submit a corresponding application there - in person, by mail, or from 2020 - through the individual’s personal account on the Pension Fund of Russia website.

    The table below shows the procedure for assigning and renewing payment of pension supplements to civil aviation flight personnel, as well as recalculating its amount.

    How to apply for a supplement to your pension from the Pension Fund?

    The establishment of additional payment refers to the application form; the pensioner must independently contact the Pension Fund with a corresponding application. To assign the specified additional pension support to certain categories of citizens, the following set of documents :

    • application for appointment;
    • about periods of work that give rise to additional payment to the pension;
    • about flight hours (for flight crew members);
    • about the average monthly salary for the last 24 months of work, giving rise to additional payment, or for any 60 consecutive months of the above work.

    Payment of pension supplements to pensioners

    This type of additional security for pensioners is paid by the territorial body of the Pension Fund on a monthly basis at the same time as the pension .

    When the pension payment is terminated or suspended, the payment of the additional payment is simultaneously terminated or suspended.

    It is subject to payment provided that the pensioner leaves work in a position that makes it possible to receive it. If a pensioner receives an additional payment and he returns to work in a position that entitles him to the same additional payment, then its accrual is suspended from the 1st day of the month following the month in which the pensioner began working again.

    Amounts of pension supplements due for payment and remaining unpaid due to the death of a pensioner are not included in the inheritance and are paid to relatives related only to the persons mentioned in Part 2 of Art. 10 of the Federal Law of December 28, 2013 No. 400-FZ “On Insurance Pensions”, who lived with the pensioner until the date of his death, if the application for uncollected amounts was submitted no later than six months from the date of death of the pensioner .

    If there are several relatives who have applied and are entitled to receive these payments, the amounts due to them are divided between them into equal shares.

    Financial support for payment costs

    Payments are financed from contributions made by contribution payers, penalties accrued for late paid contributions, and fines for illegal actions related to the implementation of Federal Laws No. 155-FZ and No. 84-FZ. The Pension Fund provides autonomous accounting of incoming contributions, penalties and fines in Russia in general.

    Financial support for the cost of additional payment is an additional insurance contribution for employers, which amounts to:

    • 6.7% of payments and incentives for coal industry workers ;
    • 14% of payments and incentives for civil aviation flight crew members .

    Failure to pay contributions by enterprises will negatively affect the amount of the surcharge.

    Responsibilities of pensioners, contribution payers and the Pension Fund of the Russian Federation

    Persons receiving a social supplement to their pension have a number of responsibilities. The pensioner is obliged to immediately notify the Pension Fund of the Pension Fund about going to work and (or) performing any other activities during the period of which the person is subject to compulsory pension insurance, about the occurrence of other circumstances that led to a change in the amount of the supplement to the pension or the interruption of its payment.

    If the information provided was incorrect or not provided on time, then the overspent funds for the payment of additional payments, the guilty persons are obliged to reimburse the Pension Fund. The excess amount paid is deducted from the pension in the manner prescribed by the legislation of the Russian Federation.

    From August 1, 2020, the amounts of additional payments to pensions for employees of coal industry organizations and flight crew members of civil aviation aircraft were recalculated.

    In the Chelyabinsk region, 2,701 employees of coal industry organizations and 545 members of civil aviation flight crews receive additional pension payments.

    After recalculation, the average pension supplement for coal industry workers is 3,266 rubles, and the average pension supplement for flight crew members is 16,890 rubles.

    Let us remind you that additional payments to pensions for coal industry workers and civil aviation flight crew members are established subject to the required special experience. The amount of the surcharge is individual and is determined by calculation using a special formula.

    The right to an additional payment to the pension is granted to persons who worked in coal industry organizations directly full time in underground and open-pit mining operations (including personnel of mine rescue units) in the extraction of coal and shale and in the construction of mines for at least 25 years or at least 20 years as workers of leading professions - longwall miners, drifters, jackhammer operators, mining machine operators and receiving pensions in accordance with the legislation of the Russian Federation.

    An additional payment to the pension for members of the flight crew of civil aviation aircraft is assigned if they have a length of service of at least 25 years for men and at least 20 years for women, and when leaving flight work for health reasons in a position that gives the right to assign an additional payment to the pension - no less 20 years for men and at least 15 years for women.

    The adjustment is carried out annually every three months (from February 1, from May 1, from August 1 and from November 1). The amount of additional payments depends on the ratio of the amount of contributions, penalties and fines to the Pension Fund of the Russian Federation received in the previous quarter from organizations using the labor of these categories of persons to the amount of funds necessary to finance these additional payments. Please note that the amount of additional payments can either increase or decrease. Recalculation is carried out automatically based on information available to the territorial bodies of the Pension Fund; pensioners do not need to provide any certificates for this.

        Changes have occurred since February 2020. For flight crew members of civil aviation aircraft, the average additional payment in the Lipetsk region is 9,129 rubles, which is 1,054 rubles less than in the previous quarter. This is due to a decrease in the amount of insurance contributions credited by enterprises to the Pension Fund budget for the payment of this pension provision in the first quarter of 2020 compared to the previous quarter.

    Supplement to pension for civil aviation flight personnel

    <On labor pensions and additional payment to the pension of civil aviation flight personnel <«>30 January 2012. Published in Pension <The PLC of Russia receives letters asking for clarification regarding the assignment of a labor pension in accordance with the <Federal Law “On Labor Pensions in Russian Federation" dated December 17, 2001.

No. 155-FZ. <The labor pension for civil aviation flight personnel is assigned in accordance with paragraph 13, paragraph 1 of Article 27 of Federal Law No. 173-FZ, which states that the old-age labor pension is assigned before reaching the age established by Article 7 of the Law (60 years for men and 55 years for women). For civil aviation flight personnel, age requirements do not apply. To qualify for a retirement pension, men must work for at least 25 years as a civil aviation flight crew, and women must work for at least 20 years as a civil aviation flight crew. When leaving flying work for health reasons, men must work for at least 20 years and women 15 years as civil aviation flight personnel. For civil aviation flight personnel, a special procedure has been established for calculating special length of service - based on total flight hours. For those who flew airplanes as ordinary crew members, the entire flight time is divided by 20 and 12 and the length of service is obtained in years. For those who have flown helicopters (regardless of their position) in the command and instructor staff and special-purpose aviation, it is necessary to divide by 12 and 12 again.

    Time spent studying at higher educational institutions of aviation, if it was preceded by work in flight positions, is counted according to the actual duration.

    To obtain the right to a retirement pension, you must have at least the following flight hours: on airplanes, transport work 6,000 hours for men, 4,800 hours for women;

    Helicopter flights are 3,100 hours for men and 2,480 hours for women.

    With 25 years of service for men, the formula for calculating the conditional pension by which the accumulated pension capital is calculated uses a coefficient of 0.55, and with 45 years of service this coefficient will be 0.75.

    Formula for calculating the conditional pension:

    1671р x (0.55÷0.75) x 1.2

    1671 rubles - the average salary in the country for 2000-2001, which was underestimated by 2 times compared to statistics

    0.55 – coefficient for 25 years of service, then 0.01 is added for each subsequent year, but not more than 20 years

    1.2 is the ratio of a pensioner’s earnings to the average salary in the country for the same period.

    For flight personnel, this coefficient is much higher, but the limit is 1.2 for everyone except northerners.

    Using this formula, a conditional pension is calculated for each employee, according to which the accumulated pension capital is calculated as of 01/01/2002... Starting from 2002. length of service is required only to obtain the right to a pension, and the amount of the pension itself will be the sum of the value calculated using the above formula, to which will be added insurance contributions made by the employer, which will be divided into years of survival (in 2012 they are equal to 18) and by 12. If the employee is younger 1967 birth, he will have an increase in the funded part of the pension.

    Due to the decommissioning of Soviet-made aircraft, navigators, flight mechanics, flight engineers and pilots were left without work. Many cannot retrain for new aircraft for various reasons, and have not earned the right to early retirement. Sometimes 50-100 hours are not enough to reach 25 years of flight time. There is a need to complete the total length of service on earth and wait until the age of 60 to receive a pension.

    PLC of Russia believes that since the work of flight crew members of civil aviation aircraft is recognized as harmful, dangerous, stressful, difficult and of a special nature, it is possible to receive an early pension in accordance with paragraph 1 of paragraph 1 of Article 27 of the Law on Labor Pensions in the Russian Federation, which states: “The old-age labor pension is assigned before reaching the age established by Article 7 of this Federal Law to the following persons”:

    1. men upon reaching 50 years of age and women upon reaching the age of 45 years, if they have worked, respectively, for at least 10 years and 7 years 6 months in underground work, in work with hazardous working conditions and in hot shops and have an insurance period of at least 20 and 15, respectively years.

    If these persons have worked in the listed jobs for at least half of the period established above and have the required length of insurance experience, they are assigned a labor pension with a reduction in the age established by Article 7 of this Federal Law, by one year for each full year of such work - for men and women.

    The problem of assigning early pensions to flight crews according to the above point is that flight crews are not included in the 1st list of hazardous work for which such pensions are awarded (for example, flight attendants at 45 and 50 years old, women and men). But there is another document. In accordance with the Decree of the Ministry of Labor and Social Development of the Russian Federation dated July 12, 1999.     Such working conditions were approved in 1997 by the “Sanitary and Hygienic Characteristics” (harmfulness, danger, tension, severity of labor of Russian civil aviation crew members) by the First Deputy Minister of Health of the Russian Federation, Chief State Sanitary Doctor of the Russian Federation G. G. Onishchenko, Director of the Federal Aviation Service Russia by G.N. Zaitsev, which were agreed upon with the PLC of Russia.

    Also, in 1997, G.G. Onishchenko and G.N. Zaitsev approved, agreed with the PLS of Russia and approved by the Chairman of the Scientific Council of the Association of Aviation and Space Medicine of Russia V.D. Vlasov, “Medical justification” (rights to increased and early retirement provision of flight personnel of the Civil Aviation of Russia in connection with the risk of loss of professional ability to work under the influence of dangerous, harmful and stressful working conditions).

    Regarding early pension provision for flight personnel in accordance with clause 1, clause 1, article 27 of the “Law on Labor Pensions in the Russian Federation,” the Russian PLC appealed to the Ministry of Health and Social Development.     On emerging problems in the implementation of Federal Law No. 155-FZ (additional payment to pensions), I suggest that you familiarize yourself with the material posted in the magazine “Pension” No. 6 for 2011.

    The maximum additional payment to the pension for February, March and April 2012 will be = 11615.45 rubles, the collection coefficient is 0.295704980. As previously predicted, the amount of additional payment to pensions decreased compared to payments in November, December 2011, and January 2012. This happened because in the third quarter of 2011, almost 300 million rubles more financial resources were received from airlines providing payments than in the fourth quarter due to the return of debts that were not paid on time. In the fourth quarter of 2011, only current payments were received, which will finance payments in February, March, and April. The PLC of Russia predicted all this back in October and warned veterans that a significant increase in the additional payment to pensions was due to additional contributions received by debtors and from February 1, additional payments to pensions would decrease. After the adoption of amendments to Federal Law No. 155-FZ, which related to the introduction of mandatory monthly and quarterly reporting on accrued and paid contributions, fines and penalties for late payment of contributions, and clarification of the basis for calculating contributions, the payment discipline of airlines has significantly improved. Funds from airlines began to flow significantly more compared to previous years.

    From 02/01/2012 The entire labor pension will be indexed by 7% and from 04/01/2012. by 2.4%. Previously, the basic and insurance parts of the pension were indexed separately. To receive a new pension amount from 02/01/2012. it is necessary to multiply the entire pension (without Moscow and regional allowances) by 1.07.

    EDV (monthly cash payments) from 04/01/2012. will be increased by 6%.

    From 01/01/2012 the aggregate rate of insurance contributions to extra-budgetary funds has changed. In 2011 it was 34%. Of these, employers paid 26% to the Pension Fund of the Russian Federation (20% was spent on paying labor pensions and 6% was cut off for the funded part of the pension), 2.9% - to the Social Insurance Fund of the Russian Federation, 3.1% and 2% - to the Federal and territorial compulsory health insurance funds, respectively.

    From 01/01/2012 the rate of insurance contributions to the Pension Fund has been reduced from 26 to 22%. The base of each employee subject to insurance premiums has also been indexed, that is, the maximum annual earnings from which insurance premiums are paid. It will increase from 463 to 512 thousand rubles (on a monthly basis from 38.6 to 42.7 thousand rubles). An additional tariff for insurance premiums has been established above the maximum value of the base for calculating insurance premiums in the amount of 10%, which will be sent not to the individual accounts of the employee, but to the solidary part of the pension for current payments to today's pensioners. The burden on the wage fund from high earnings has increased and this does not please, including aviation employers.

    <The rate of insurance contributions to the Social Insurance Fund and the Compulsory Medical Insurance Fund has not changed. It remains at the 2011 level. On deductions of contributions by airlines in accordance with the Federal Law of November 27, 2001. No. 155-FZ no changes occurred.
