Law “On Insurance Pensions” No. 400 FZ
This law establishes, regulates and determines the conditions under which a person can count on an insurance pension. It means a monthly payment to insured disabled persons or relatives who have lost an insured breadwinner. This bill was approved at the end of December 2013 and came into force on January 1, 2015.
Chapter 1 establishes general provisions, concepts, types of insurance coverage, and to whom they are due. These subsidies can be paid in three cases:
- upon reaching a certain age;
- for loss of a breadwinner;
- upon the onset of disability.
Both Russians and foreigners can lay claim to it. Both are subject to certain conditions. It is also possible to simultaneously provide two different types of subsidies.
The second chapter explains all the conditions for assigning payments. In old age, men can receive funds at the age of 65, and women - 60. In this case, the IPC must be at least 30 points, and the minimum length of service is 15 years. These indicators are not mandatory now since the country is undergoing a smooth transition aimed at achieving exactly these figures.
A disability insurance pension is issued to people who have medical and social examination conclusions for disability groups I, II and III, as well as work experience of at least 1 day. If this is not the case, a social benefit is assigned.
Disabled dependents can count on financial assistance in the event of the loss of a breadwinner: children, siblings, parent, spouse.
The third chapter of the federal law on insurance pensions is devoted to length of service. It specifies the periods that are taken into account in the insurance period, the calculation, calculation and confirmation of this indicator.
To determine the amount of insurance financial assistance, you should refer to Chapter 4, which provides formulas for calculation. The values of the indicators used for calculation are relevant at the time of applying to the Pension Fund of the Russian Federation with an application.
This part of the law also talks about fixed payments to the insurance pension, which is indexed annually, and about the conditions for increasing the size of fixed payments. The share of insurance pensions for civil servants and test pilots is calculated.
The fifth chapter of the law specifies the timing and procedure for assigning insurance payments, cases when the pension stops being paid and when it can be resumed, as well as how financial assistance is paid to working pensioners and those living outside the Russian Federation.
