If there are insufficient grounds for granting patronage to an elderly person, the applicant will receive a written refusal explaining the reason. Otherwise, the specialist reviewing the information will begin to prepare the appropriate order, which will set out the required form of guardianship over the elderly citizen. Copies of this document will be sent to the caregiver and their ward.

How many people over 80 can I look after at one time? Is there a limit

Hello! How many elderly people over 80 can I care for at the same time (with benefits, of course)? I'm already looking after three of them. And four more (they all live in the same house) ask to provide services to them. That's already seven. Is this legally possible?

Good evening! Based on the text of Decree of the President of the Russian Federation dated May 13, 2008 N 774 “On additional measures of social support for persons caring for disabled citizens,” the number of pensioners over 80 years of age who can be cared for by one non-working able-bodied person has not been established; compensation is established for each elderly person over 80 years, that is, it is possible to care for seven, it all depends on your physical abilities.

At what age can you apply for benefits to care for an elderly person?

The appearance of a disabled person, a bedridden patient or a frail old person in a family is a great stress for all relatives living next to him. An elderly person cannot move independently, go for a walk, cook food, take a bath, or even relieve himself. All this leads to the fact that it needs to be constantly monitored and looked after.

According to Art. 10 No. 48-FZ, guardianship of an elderly person aged 80 years or older can be granted to a minor citizen of the Russian Federation. Most often, guardianship of children is granted in cases where all family members officially work, but at the same time they want to receive benefits and monetary compensation from the state.

Who can care for an elderly person

The law today does not have clear restrictions on social or family grounds regarding who can care for a person in old age. The following may take responsibility:

  • one of the relatives of an elderly patient;
  • neighbor or friend;
  • a complete outsider doing this out of his own financial self-interest.

Requirements for a candidate

Despite the absence of restrictions regarding social status or family ties, not everyone can take care of an elderly relative and parents. There are a number of requirements for the candidate. Among them:

  • presence of Russian citizenship, and permanent residence in the country appears as an additional condition;
  • strict age limits (the candidate must be at least 14 full years old, he must not be older than 55.5 years if he is a woman or over 60.5 years old if he is a man);
  • lack of other sources of funds (the exception here is students who are allowed to combine care for the elderly and receiving a scholarship while studying full-time);
  • availability of work ability (the person should not have physical limitations that could interfere with fulfilling the role of a caregiver);
  • lack of records from a psychiatrist or narcologist.

The caregiver and his ward do not have to live together. The main thing is that the first one has Russian citizenship. At the same time, people can be registered in different cities - there is nothing wrong with that. Moreover, in Moscow, live-in care for elderly people without intermediaries is in great demand, as it allows them to live in the capital

What are the responsibilities

A trustee has a fairly wide list of responsibilities. These include:

  • purchasing various necessary things, including food, medicine (payment comes from the pensioner’s funds, the trustee does not spend his own funds);
  • payment of various bills, including utility bills;
  • various activities to clean up the apartment (for example, dusting, wet cleaning, washing floors, dishes, etc.);
  • assistance in carrying out hygiene procedures (combing, washing, taking a shower or bath, etc.);
  • monitoring the physical condition of an elderly person (for example, measuring temperature, pressure, blood sugar levels in diabetes mellitus, etc.);
  • if necessary, calling a doctor, receiving a medical worker in the apartment or accompanying the ward to the clinic.

Geriatric nursing homes typically take on all of these responsibilities. However, not every older person wants to change their usual apartment to a boarding house. It is in this case that the optimal solution is to formalize care: the relative does not need to leave his usual environment, it is easy for relatives and friends to visit him.

The age at which you can officially provide care for the elderly

Note. If an elderly person after 80 years of age receives a fee for scientific activities, lecturing in higher educational institutions, care for him can only be carried out on a voluntary basis, without formalizing compensation and taking into account work experience. The limitation for receiving benefits is a second pension for an incapacitated citizen, which is usually issued if the person served in the law enforcement agencies.

  1. Teenagers over 14 years of age, with the consent of one of their legal representatives, if light work is performed in their free time from school.
  2. Persons who have reached the age of 15, after receiving general education (parental consent is not required) or undergoing the training process, without prejudice to the development of the educational program.
  3. Boys and girls 16-18 years old.

What you need to do to register

To accrue IPC for elderly care, several important conditions must be met:

  • obtain the consent of a disabled elderly person;
  • the citizen is an elderly person, and according to the decision of medical workers, he needs care (a certificate from a medical institution is needed, in the second - a copy of the document that identifies the elderly citizen);
  • a person intending to take care of an elderly person must be able to work, but not work officially, he does not receive a pension, is not an entrepreneur, or receives payments from the employment service due to unemployment. Teenagers have the opportunity to provide care from the age of 14 with the consent of their parents (they must provide documents certifying that they are not currently working).

Having fulfilled all the above conditions and collected all the documents, the citizen submits them to the Pension Fund at the place of registration. This can be done either at the end/beginning of care, when applying to the Pension Fund for registration of pension payments.

Benefits and payments for caring for an elderly person in 2020

The amount of compensation is fixed. In 2020 it was 1200 rubles. However, in some regions it increases by a multiple of the northern coefficient. The compensation is paid monthly along with the pension accruals of the elderly citizen. A separate account with the Pension Fund is not issued for her.

  1. For each year of official care for an elderly person over 80 years old, 1.8 pension points are awarded.
  2. To receive them, you must interrupt your work activity before leaving the job and return to it immediately after the end of the contract.

Attention: pension points are accrued on the basis of an agreement with the guardianship authorities on the provision of care for an elderly person. Without providing the document, the Pension Fund will not count this period into the pension period.

How to apply for an aged care pension

You will also need to write an application for compensation payment. Usually it is drawn up according to a sample. This application must indicate:

  • name of the Pension Fund branch;
  • details of the applicant, including SNILS number, passport details, citizenship and telephone number;
  • applicant status (not working/student/pupil);
  • the day from which the person began to actually care for the elderly;
  • the circumstances due to which the elderly person began to need care (usually age and medical diagnosis are indicated here);
  • a request to accrue a pension for caring for the ward;
  • list of documents;
  • signature along with the date.

Also in this document, the applicant must indicate that he has been notified of the need to notify the Pension Fund if his circumstances related to employment change, or the elderly person refuses its help.

Review period

The standard period for making a decision is 10 calendar days.

In case of refusal, Pension Fund employees are required to notify both parties within 5 days. In this case, 30 days are given to supplement the application with certificates.

If the decision is positive, then the payment is calculated and assigned from the moment the application is submitted for consideration.

Where to submit

The application and accompanying documents are submitted personally to the Pension Fund or sent through the State Services portal. For convenience, when meeting in person, you can select the date and time of the meeting.

If you are caring for several pensioners at once, you will need a separate application for each. In this case, the papers are transferred to the place of residence of the old man.

Terms for consideration of the application and grounds for refusal

Representatives of the Pension Fund of the Russian Federation consider the application within 10 days from the date of submission. During this period, the information reflected in the attached documents is verified. Once a decision has been made, the applicant must be notified within five working days. What may be the grounds for refusing an application for care benefits for the elderly over 80 years of age:

  • There is no document (it must be provided within three months).
  • The applicant is employed (has an income or is an individual entrepreneur).
  • Information in documents is distorted or unreliable.

Compensation is transferred along with the pension every calendar month. The money is handed over to the elderly person, who himself hands over the required amount to his caregiver. Conditions under which an able-bodied person caring for a pensioner 80 years of age or older can apply for inclusion of the period of care in his total length of service (for which an insurance pension is assigned): 1.

Availability before the start of care or after its end of official activity with income reflected in the work book.
2.
The benefit is indexed:

  • from 1.8 units annually;
  • the number of wards does not affect.

Art. 12 of the Federal Law of December 28, 2013 N 400-FZ “On Insurance Pensions” stipulates that periods of caring for the disabled are included in a citizen’s insurance period . Thus, compensation and monthly payments are a special type of state support, which provides not only material support, but also the opportunity to earn a labor pension (otherwise, due to caring for a sick person, an able-bodied person cannot work and, therefore, form an insurance pension).

Does time spent caring for a pensioner count towards seniority?

Yes, this issue goes and is regulated by paragraph 6 of Article 12 of the Law of the Russian Federation “On Insurance Pensions” No. 400 of December 28, 2017 . However, there are amendments here.

Thus, the periods during which a person cared for a pensioner over 80 years of age will be counted in the insurance period only if the person previously worked before caring for the elderly person or if after caring for the pensioner he got a job.

Compensation is a great motivator for caregivers who want to increase their service in anticipation of future retirement.

Caring for a pensioner over 80 years of age: documents for registration

Any entrepreneurial activity of the guardian (for example, lawyer, security) is regarded as work if he has a valid individual entrepreneur status, even if the non-working entrepreneur temporarily has no income at the time of receiving payments. Students/pupils can receive compensation, since study is not included in the work (insurance) period, and student scholarships are not counted as income.

The documentation required to process the refund can be sent through the official website of government services or transferred to the Pension Fund (territorial office) in person. For personal treatment, it is possible to make an appointment in advance via the Internet, which saves time by avoiding queues. The benefit is assigned by the branch of the Pension Fund, which accrues a pension to the elderly person.

Documents for registration of care for the elderly

The parties to the agreement submit the required documents to the Pension Fund (local branch) to formalize care for the elderly. On their basis, the person’s compliance with the obligations imposed on him is assessed, and the right to receive benefits from the state is verified.

A person wishing to provide care for an elderly person should submit for consideration:

  • passport;
  • work record book (with the exception of school/university students);
  • certificate of compulsory insurance (SNILS);
  • certificates from the Pension Fund and the employment center about the absence of payments;
  • permission to provide assistance to an old person (when registering care for minors);
  • certificate from the place of study (for students and students).

It is possible that the Pension Fund authorities will request other documents, a full list of which should be previously clarified on the website or by calling the regional service.

An elderly person who requires care is also required to provide a list of documents:

  • passport of a citizen of the Russian Federation;
  • employment history;
  • certificate of insurance;
  • certificate of disability group;
  • certificate of the need to receive constant care (issued at a medical institution to elderly people over 80 years of age).

The entire package of official papers is submitted for consideration. Applicants are given official notification that they have been hired. Processing of documents takes no more than 10 working days.

The decision on the issue can be positive or negative. The applicant is notified of the rejection of the application within 5 days after the decision is made. An additional 3 months are allocated to resolve the situation and appeal the result. Benefit accrual begins on the date the application for care services is approved.

How to take care of your grandmother and receive pensionable service

  1. You got a job, applied for unemployment benefits or a pension. Within 5 days, visit the Pension Fund and write a statement about termination of care. You now have income and are no longer entitled to compensation. Payments will stop starting next month. During this month, the pensioner will receive them in full for you, even if you wrote the application at the beginning of the month.
  2. You received a one-time remuneration (fee, paid internship, etc.). Within 5 days from the moment the money is transferred to you, personally notify the pension fund about this. The contract with you will not be terminated, but compensation for the month when you received income will not be accrued.
  3. A sponsored pensioner died. Report this to the Pension Fund within five days. You will no longer receive compensation and length of service.

But a situation may arise when a pensioner begins to demand more services than you agreed upon. Or he will fall ill with a serious illness, and he will need serious care that you are not ready to provide. It’s up to you to decide what to do here. You sign a contract to care for an elderly person voluntarily and can unilaterally terminate it at any time. You just need to write an application to the Pension Fund.

Circumstances under which elder care benefits are terminated

The aged care pension can be revoked for the following reasons:

  • an elderly person moved to permanent residence in a government institution;
  • the ward has died;
  • the caregiver applies for unemployment benefits or an old-age pension;
  • an elderly person or a person caring for him is declared missing;
  • the parties jointly or unilaterally decided to end the further relationship (for example, their own children remembered their parents and took them to their home).
