Early pension for public transport drivers

Only drivers of urban public transport know how much tension and concentration it takes to work in heavy traffic on city roads. Attention! The pension reform, which provides for raising the retirement age, does not deprive drivers of the right to early retirement. For those who have developed special experience as drivers of buses, trolleybuses, trams on regular city passenger routes (men and women), the retirement age will not increase from 2020.

An old-age insurance pension before reaching the generally established retirement age is assigned:

for men - upon reaching 55 years of age, subject to working on regular city passenger routes as drivers of buses, trolleybuses, and trams for at least 20 years;

for women - upon reaching 50 years of age, subject to working on regular city passenger routes as drivers of buses, trolleybuses, and trams for at least 15 years.

In this case, the insurance period for men must be at least 25 years, for women at least 20 years. At the same time, in 2020, a mandatory condition for the appointment of this type of pension is the presence of at least 13.8 pension points (coefficient). Every year the requirement for the minimum number of pension points will increase, until it reaches 30 in 2025.

In order to receive an early pension, drivers must document that they were employed only on regular city passenger routes. Drivers of fixed-route taxis, intercity buses, drivers working on suburban routes, as well as those performing customized transportation on routes within the city, but not regular city routes, do not enjoy the right to early pension provision - transportation of passengers on ordered routes is not a regular passenger route, but It also does not provide for the pick-up (disembarkation) of passengers along the route at every public transport stop.

The right to early pension provision is given by carrying out transportation on regular city passenger routes continuously for a full working day (at least 80% of working time).

Permanent employment in the specified jobs can be confirmed by the following documents:

- orders for appointment to work as a bus (trolleybus, tram) driver on regular city passenger routes

- waybills

- certificates from enterprises issued on the basis of orders, personal accounts, payroll statements, which indicate payment of labor at increased tariff rates or additional payment for work on regular city passenger routes.

The main document confirming work experience in these types of work for periods before registration as an insured person in the compulsory pension insurance system (receipt of SNILS) is the work book. After registration in the compulsory pension insurance system, periods of work are confirmed based on individual (personalized) accounting information. Such information (indicating the special nature of the work) is personally provided for each employee annually by the employer to the territorial bodies of the Pension Fund of the Russian Federation.

Raising the retirement age will not affect public transport drivers

Public transport drivers working on regular city passenger routes are entitled to a number of pension benefits for their hard work. The Branch of the Russian Pension Fund for the Republic of Tatarstan reminds us of this.

The following categories of drivers have the right to early establishment of an insurance pension due to special working conditions:

- men who have reached 55 years of age, who have worked as drivers of buses, trolleybuses, and trams on regular city passenger routes for at least 20 years and have an insurance record of at least 25 years;

It is worth noting that a preferential pension is provided only if there is documentary evidence of the drivers performing regular passenger transportation within a populated area, using vehicles with more than 8 seats. In the Novosibirsk region, there are 686 recipients of early pensions from among drivers employed on regular city passenger routes.

Drivers of buses, trolleybuses, and trams on regular city passenger routes have the right to early establishment of an old-age insurance pension due to special working conditions.

Assignment of an early insurance pension to a minibus driver

A man, let's call him Gregory, turned to me for legal assistance, who, by decision of the Pension Fund, was denied an early old-age insurance pension in accordance with clause 1, part 1, art. 30 of the Federal Law of December 28, 2013, Federal Law No. 400-FZ “On Insurance Pensions” due to the lack of required experience in the relevant types of work.

The preferential length of service did not include the period from 07/06/2005 to 03/01/2016 (10 years 07 months 25 days) as a minibus taxi driver in the Kemerovo Auto Column State Enterprise.

According to clause 10, part 1, art. 30 of the Federal Law of December 28, 2013 No. 400-FZ “On Insurance Pensions”, an old-age insurance pension is assigned before reaching the age established by Article 8 of this Federal Law, if there is an individual pension coefficient of at least 30: for men upon reaching the age 55 years and women upon reaching the age of 50, if they have worked as drivers of buses, trolleybuses, trams on regular city passenger routes for at least 20 years and 15 years, respectively, and have an insurance record of at least 25 years and 20 years, respectively.

In the decision to refuse to grant an early pension, the Pension Fund referred to the fact that clause 10, part 1, art. 30 The Law “On Insurance Pensions” does not provide for the position of “minibus taxi driver” - there is only “bus, trolleybus, tram driver”.

The second argument was the lack of confirmation of special experience with individual registration information.

In the statement of claim, we referred to the fact that the working conditions of a minibus driver and a bus driver are identical - increased danger of traffic, frequent stops, the work schedule is associated with an early start of work and a late end, traffic intensity on city routes.

Essentially, we were faced with 2 tasks:

  • prove that Gregory was busy on regular city passenger routes during the disputed period;
  • prove that during the disputed period they performed work full time.

For this purpose, waybills, pay slips (payslips), the employee’s personal card, and passports of the routes on which Grigory worked during the disputed period were added to the case materials. I was pleased that the employer had all the necessary documents for the entire period. In addition to waybills, which are stored for only 5 years, i.e. they were able to provide us with waybills only for 2012-2016.

At the court hearing, the judge proposed conducting an examination of working conditions, which “will not cost us anything.” It was difficult to refuse such an offer, although I personally was worried about the possible conclusions of this examination.

But it was necessary to go to the end - she filed a petition to appoint this examination. Appointed.

The expert was asked 2 questions:

  1. Does Gregory’s work as a minibus taxi driver during the controversial period correspond to work as bus, trolleybus, and tram drivers on regular city passenger routes, as provided for by the Law “On Insurance Pensions” for the early assignment of an insurance pension?
  2. During the specified period, was Gregory’s work performed under full-time conditions, that is, at least 80% of the working time?

To the first question, the expert gave an affirmative answer - Grigory’s work during the controversial period corresponded to the work of a bus driver on regular city passenger routes.

The expert could not answer the second question. But in the text of the examination itself there is a hint: “the employer can confirm full-time work with a certificate.”

But the employer did not want to give such a certificate, with the words “We don’t give such certificates to minibus drivers, only to bus drivers.”

But... I managed to convince the employer that a certificate confirming my client’s full-time employment as a minibus taxi driver would not harm anyone. And the treasured certificate was received!

At the court hearing, it was added to the case materials and on the same day the court satisfied our claims.

The court ordered the Pension Fund to assign Gregory a pension from the date of his appeal - 03/01/2016.

The appellate instance left the decision unchanged and the appeal was not satisfied.

The difficult conditions of our life often cause a situation to arise in which, at certain motor transport enterprises, bus drivers are forced to combine work on regular city passenger routes with work on suburban routes, or carry out custom transportation on routes that are not regular city routes. In this case, the question of the right to early assignment of a pension is decided depending on what percentage of a driver’s working time on a regular route is his main profession, which alone can give him the right to receive this pension. If, when performing the above work, the employment of drivers on regular city passenger routes is at least 80 percent of their total working time established for representatives of this profession in accordance with labor legislation, then they can be considered as workers employed full time in work that give them the right to early pension provision from the state.

Let us also recall that the periods of work of drivers on regular city passenger routes for two and a half years, starting from 2013, are counted towards special length of service, taking into account which their right to early receipt of an old-age pension is formed, subject to the payment of insurance contributions by the employer. additional tariffs. It should be emphasized that after a special assessment of his working conditions is carried out directly at the driver’s workplace, the corresponding periods of work will be counted towards special experience only if, based on the results of this special assessment, a harmful class of working conditions is established at the driver’s workplace.

Despite all the known difficulties, according to experts, among other reasons, it was the right of representatives of the driver profession to early retirement that determined the greatest popularity of this profession among citizens looking for work in May of this year in the city of Novosibirsk, as evidenced by statistics collected by the regional OPFR. Suffice it to say that in Novosibirsk and the Novosibirsk region there are almost 700 recipients of early pensions in the recent past - drivers on regular city passenger routes.

Drivers of buses, trolleybuses and trams employed on regular city routes can retire earlier if a number of important conditions are met.

According to the NHS research service. The most popular profession sought by Novosibirsk residents in May of this year was that of a driver, including in public transport. It is worth noting that some representatives of this profession have the right to early assignment of an old-age insurance pension. This category includes drivers of buses, trolleybuses, and trams employed on regular city routes.

The listed citizens can retire earlier than the generally established retirement age: men at 55 years old, and women at 50. But for the right to early retirement to arise, a number of important conditions must be met. First of all, they need, like all citizens, to “collect” at least 30 pension coefficients throughout their working life (taking into account transitional provisions). The second condition for the assignment of a “preferential” pension is the length of the insurance period in the relevant jobs. So a man with a total insurance experience of 25 years must work as, for example, a bus driver on a city route, for at least 20 years. Women must have a total insurance experience of 20 years, and at least 15 years in the relevant types of work.

The basis for granting the right to pension benefits to drivers of buses, trolleybuses or trams is full-time work only on regular city passenger routes. For bus drivers, the period of work is included in the required special experience when employed in bus regular urban passenger transportation. This fact must be documented. Orders for appointment as a driver of regular city passenger routes, waybills, personal accounts, pay slips, collective agreements and other documents containing the necessary information are considered as supporting documents.

Regular urban passenger transportation includes transportation on a regular route that runs within the city limits; the traffic schedule on such a route is approved and agreed upon with local authorities in the interests of all city residents. On such routes, transportation is carried out at certain intervals according to a schedule with passengers boarding and disembarking at stops provided for on the route. The bus must proceed to all intermediate checkpoints on the route according to the schedule.

Urban passenger bus transportation includes regular transportation, which is carried out by a vehicle intended for the transportation of passengers, with a number of seats (in addition to the driver) of more than 8.

Work on urban passenger regular routes can be organized with semi-express, express or regular traffic modes, or a combination of these modes during the day.

Such drivers enjoy the right to pension benefits subject to documentary confirmation of the requirements for city passenger regular bus routes.

Drivers working on suburban, intercity, specialized routes, as well as drivers carrying out custom transportation of passengers on routes other than regular city routes, or drivers of departmental transport transporting enterprise employees are not entitled to pension benefits.

If, during working hours, along with work on regular city passenger routes, a bus driver combines work on suburban routes or carries out custom transportation on routes not classified as regular city routes, then the question of his right to early assignment of a pension is decided depending on what percentage working time consists of work that gives the right to this pension. If it is documented that employment on regular city passenger routes is at least 80% of the working time, then in this case they can be considered employed in jobs that give the right to early pension provision.

When recording working time in aggregate, working time confirming the employment of bus drivers on regular city passenger routes is determined based on the results of the month. The working time for a month includes the total time of work on the line on a regular city route, time for carrying out preparatory and final work, conducting pre-trip and post-trip medical examinations, eliminating operational faults of the bus while working on the route, and scheduled maintenance.

In addition, periods of work of drivers on regular city passenger routes after January 1, 2013 are counted towards special length of service, taking into account which the right to an early old-age pension is determined, only if the employer pays insurance premiums at additional rates. After a special assessment of working conditions has been carried out at the workplace, periods of work will be counted towards special experience only if, based on the results of the special assessment, a harmful class of working conditions is established at the driver’s workplace.

In the Novosibirsk region, there are 686 recipients of early pensions from among drivers employed on regular city passenger routes.

Drivers of buses, trolleybuses, trams, and those working on city streets can take advantage of the right to retire early.

Early pension for drivers of urban passenger transport

Persons working as drivers of buses, trolleybuses, trams on regular city passenger routes can exercise their right to an early retirement pension if the following conditions are met:

A regular urban passenger route is a predetermined and approved transport route, movement along which is carried out at a certain frequency (regularly) and with mandatory stops in specially designated places.

The right to early retirement pension in old age will not apply to those persons who work as drivers of buses, trolleybuses and trams, but on other routes (suburban, intercity, etc.).

An example of assigning an early labor pension in old age

Citizen Ivanov (age 55, has 35 years of total experience) worked as a bus driver on regular city passenger routes for 10 years, as a bus driver on a suburban route for 5 years, and as a bus driver on a specialized route within the city for 5 years. In this case, only a 10-year period of work as a bus driver on a regular city passenger route will be counted towards his special work experience for the purpose of an early retirement pension.

When exercising the right to an early retirement pension in old age, bus drivers should be guided by the letter of the Ministry of Transport of the Russian Federation dated July 2, 1992 No. 13-pr “On the procedure for confirming the special work experience of bus drivers who worked on regular city passenger routes.”

Full working time means performing work on such routes for at least 80% of the working time per month.

Confirmation of special work experience for the appointment of an early retirement pension for bus drivers is possible on the basis of the following documents:

  • orders on the appointment of a bus driver on regular city passenger routes;
  • waybills;
  • certificates from enterprises indicating documentary grounds (orders, personal accounts, payroll statements, collective agreements, etc.).

When transferring drivers due to production needs to work on repair and maintenance of cars for a period of up to 1 month, as well as to work related to the mass transportation of children to summer health camps and country kindergartens, work on transporting workers of urban enterprises to collective and state farms to provide assistance in carrying out agricultural work, the time associated with the performance of such work is equated for the purpose of granting an early old-age labor pension to previous work on a regular city shuttle bus.

According to Article 13 of the Law of Ukraine “On Pensions”, the following can take an old-age pension on preferential terms:

  • drivers of urban passenger transport (buses, trolleybuses and trams);
  • drivers of heavy vehicles involved in the technological process in heavy and hazardous industries.

Male drivers have the right to retire after reaching the age of 55 and with 25 years of work experience , of which at least 12 years and 6 months of work experience, which gives the right to reduce the retirement age. In turn, female drivers can retire after reaching 50 years of age and with 20 years of work experience, of which at least 10 years of special experience.

Also, according to the above article, the following have the right to a preferential pension:

  • male tractor drivers directly involved in the production of agricultural products on collective farms, state farms, and other agricultural production enterprises - after reaching 55 years of age. Moreover, their total work experience must be at least 25 years, of which at least 20 years in a job that entitles them to benefits ;
  • women who work as tractor drivers, drivers of construction, road machinery and trucks mounted on tractors and excavators - after reaching 50 years of age. Their total experience must be 20 years, and their special experience must be at least 15 years.

Prepare your documents

At the same time, the driver’s preferential length of service in each specific case when applying for an early pension must be documented. According to the clarification of the Ministry of Social Security of Ukraine No. 18 dated July 1, 1992, a special commission created at the automobile enterprise has the right to issue a supporting document. This commission should include representatives of the enterprise administration, trade union, social protection department, as well as the workforce . The commission, based on available documents and testimony, must determine the amount of preferential length of service for each driver.

The decision of the commission is documented in a corresponding protocol, which is signed by the members of the commission and approved at a meeting of the labor collective. This protocol is a document confirming the preferential length of service .

The driver must provide an extract from this protocol to the territorial Administration of the Pension Fund of Ukraine when applying for an early pension, along with all other documents: the relevant application, work book and salary certificates, if the period before 2000 is taken into account when calculating the pension.

Having fulfilled all the conditions, the above categories of drivers will be able to receive a pension earlier than the generally accepted retirement age in the country.

Tractor drivers directly involved in the production of agricultural products include: workers who are officially registered, have appropriate certificates , and are constantly employed on tractors and other self-propelled machines throughout the full season of agricultural work in crop production and livestock breeding

Basic moments

A preferential pension for a professional driver is a relative innovation for the Russian pension system. The right to early retirement is established in accordance with 400-FZ, paragraph 10, paragraph 1 of Art. thirty.

But not everyone can take advantage of early retirement. A preferential pension for drivers is provided if:

  • the minimum number of points has been accumulated by the time of applying for a pension (16.2 in 2020, increases to 30 points by 2025);
  • the citizen drove a bus, trolleybus or tram;
  • accumulated total insurance experience of 25 years (for men) or 20 years (for women);
  • the citizen was engaged in regular transportation on city routes;
  • the duration of special experience is equal to or exceeds 20 years (men) and 15 years (women);
  • the employer paid contributions to the Pension Fund at additional rates;
  • Based on the results of a special assessment, harmful working conditions are established.

The generally established retirement age and its changes in 2020 do not apply to this category of drivers. If all conditions are met, the citizen can go on a well-deserved rest. In this case, the retirement age is set in the following values:

  • 55 years for men;
  • 50 years for women.

Muscovite Anatoly L. turned to a lawyer for advice. The man wanted to take advantage of special conditions for early retirement and was interested in whether he could apply for a pension if his total work experience as a driver was 27 years, 19 of which the man drove a bus on a city route and 8 years spent “behind the steering wheel” of a school bus. The lawyer pointed out that, according to the provisions of 400-FZ, the man lacks 1 year of work experience on a city bus, trolleybus or tram. A school bus is not a city route bus, and therefore work on it does not count towards special experience.
